      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi,

 

i had a guy come around to my mothers house today who she says was wearing a magistrates court badge and was asking for me, ive started living with my girlfriend now so i wasnt there but didnt make them aware of it as its my girlfriends parents house and i didnt want them involved as i was paying £10 a month which was decided a while ago as i was out of work and thought id made the last payment 3 weeks ago but think it is 5 now. . (the balance on the debt is £150 by the way).

my mom told him that i had moved but didnt say where and he didnt give her a letter or anything just said ok ill tell them that this isnt your current address and left.

what will be there next step , im going to call them and tell them that sorry for missing the last payment and can i carry on but in this situation what would there usual next step be with an amount like this.

 

apparently the guy was really nice to my mom and said im not even sure why theyve sent me as its only for £150 pound.

You are correct to call them to discuss the matter, IMHO you should inform them of any change of circumstance making an offer to pay what you can

hi,

 

im not very good at this sort of thing and i tried ringing and there was no answer twice so i sent this email and kept notes of times and dates. It might sound like i dont have a backbone but as i said i want this to just be over and done with and i do have epilepsy which is what is meant below

I rang and left a message but have had no reply so i thought id deal with this matter through email.

 

I am in a relationship with my girlfriend and i stay over hers every now and then and it just so happens that ive been there for about a week or two and my mother told me that she had a guy call at the house asking for me the other day when i was at work. She told me she was a bit flustered at the time and told him that i didnt live there which she said she then thought might have confused them because she was supposed to say that i wasnt staying there at the time. But i was just ringing to say that as i am working on a temporary christmas vacancy at the moment, rather than pay a monthly amount as i have done previously i will be receiving payment from my job around 14 days after christmas and i can pay the full amount then which if i remember correctly being around £170.

I can get very nervous sometimes on the phone as i have epilepsy which is caused by getting over heated and when i get into a situation like this it makes me really nervous on the phone which can then lead to a seizure and because of the mix up with my wages at my new role i was worried that you guys wouldnt understand and i would be put in one of these awkward situations which would make me nervous therefore maybe leading to another seizure which i want to try and avoid.

 

I believe there is many people out there who have debts of £10000+ so i believe as mine is so small this is a reasonable offer as it would only be around 4-5 weeks until the full payment was made.

To prevent the Court issuing a warrant of committal for your arrest which could result in you spending up to 14 days imprisonment we require a good faith payment for any amount that you can afford to pay and the Form N56 (Attachment of Earnings income & expenditure form) which I have today sent to 52 Longley Crescent completing in full and returned to this office no later than 17th December 2009.

 

We note that it is your intention to settle this account in full. Please confirm the exact date your wages will be paid in order to conclude the account. We can then provide you with a method of payment.

Dear Mr Delves,

 

As I am in a temporary Christmas role my contract ends on December 26th so there could not be an attachment of earnings because, as far as i know, i will be unemployed from this date until i find new work. With regards to the dates of my wage payment i shall have to check this at work tomorrow so that i pass on to you the correct information.

Also as I told you previously I will have the full balance around 14 days after Christmas with which on the day that it goes into my account would be transferred to yourselves, the date of which as I mentioned would have to be confirmed tomorrow.
