A collegue of mine has just been given the above for nubbing a cigarrette out on a wall outside of our workplace. It was given to her by a council official. Do they have the powers to do this? If not what can they do about it?

If your colleague dropped the cigarette butt then it constitutes litter, and there have been a lot of cases where this has happened.

 

If they retained the butt and then disposed of it in a bin then they have an argument.

Yep - it is not the extinguishing, but the littering. The FPN is not de-criminalised, and if challenged will result in the case going to District Court.
