Hi,

 

I asked MBNA for my CCA nearly four months ago now. They still haven't provided and after the usual default letters they are now sending me letters saying they will take me to court or contact my employer for monthly deductions of my salary or bayliffs. I see this as the usual threats expected and understand it really isn't within their interests to take me to court based on the fact they have not produced my CCA. My last letter to them nearly 2 months ago was along the lines of 'I do not acknowledge any debt to your company and wish it this to be confirmed in writing along with all the usual parts stating my rights under the CCA. They recently phoned me to say I need to pay and I told them legally I am entitled not to pay until you have produced CCA. They say they sent it to me back in Sept (which I have definitely not received. Funny! how I have received all the threats and defualt letters but not my CCA. They said I need to write to them again requesting it and tried to push me in to paying and then said "well, ok so you are refusing to pay" and that;s what we shall put on the account. I said "No, put it down as I am not legally entitled to pay until I receive my CCA.

 

Any ideas what to do?
