In 2005 somebody obtained a Lloyds TSB credit card using my details without my knowledge and spent the £6000 credit limit. I believe it was a person who I considered at the time to be a friend but has since gone missing. The first time I knew about it was in March 2008 after obtaining a credit reference. Since then I have been trying to get Lloyds TSB to accept this is not my debt, although they are not pursuing for this debt they refuse to cancel it . Since October 2008 it has been in the hands of the FOS which is still ongoing (I am not confident of the outcome). I informed the police in April 08 but they said it was a matter for Lloyds TSB and also that they considered it would be difficult to trace the person I suspect and bring a case against them.

I am trying to bring this to a conclusion, but Lloyds seem to be happy with the situation as it is, not pursuing me but also not wiiling to remove it from any credit reference against my name. Any suggestions or advice will be gratefully received

Thanks

You may be well served to push Lloyds with a fraud angle. The person who got the card in your name commited fraud but you could also argue that Lloyds have been an indirect party to this by fraudulently/falsely tarnishing your credit report for a debt that is not yours. Not sure on the legal standing of this so it might be wise to seek professional advice.

I'm shocked, but not surprised, by the police response. Fraud is a criminal offence so they should at least make some attempt to investigate it. This may also put some pressure onto Lloyds to rectify their mistakes with your credit file.

Lloyds TSB have produced what they claim is the original credit agreement with what looks like my signature on it. I know I have not seen it before and I did not sign it, also it does not have any details of my work or any income on it (at the time I was unemployed). It also does not have my full name on it. Again I would be grateful for any comments

It might be worthwhile also contacting the CRA's directly (Experian, Equifax etc) and informing them that Lloyds have as a result of fraud placed a default on your credit report that shouldn't be there. The CRA's have a duty to only put information on your file that is accurate. In this instance the default is far from that.
