a warrant officer called today whilst me and my partner were out and left a card saying

' called today to arrest and take you into custody'

failing to contact me on above number

- day or night arrest ... ermm

it says the amounts for £737 pounds ,

 

now im assuming this might be for a fine that my partner got from driving last yr ,

but we have moved since,

and didnt hear anything up until we moved which would have been at least 9 months after the incident accured ,

 

so they have found our new address and just posted a card thru the door,

i know my partner stuck her head in the sand on this one ,

and shes not paid yet but ,

 

can this warrant officer actually arrest her over this and keep her in custody until a hearing can be placed

or is he just bluffing ??

doesnt say either ....

 

it says on the top hmcs south wales area finance unit

 

on the back of the card it says :

notice of warrent of arrest

 

i have called today to execute a warrent for your arrest in connection with the non-payment of your account

please contact the warrent officer on the mob number overleaf to discuss this matter

 

warning :

 

failure to make immediate contact OR PAY in full may result in you being arrested and placed in custody at any time

and if necessary held until the next court date ...

it should say who left it , cant just say warrant officer

 

what was the phone number

 

in that case you must contact them to save further problems

it says on the front YOU HAVE RECEIVED A VISIT FROM A WARRENT OFFICER then his name then his mobile number then account number an amount owed .

A warrant officer is a process server, he just serves legal document on people that have be delivered, read aloud to and understood by the recipient. When done, he files a signed affidavit at court confirming the above.

 

They only have a power of arrest of they have a uniformed police officer present who carries out the arrest and holds a document called a Power of Arrest and signed my a magistrate.

 

Check you case, if the process server has made an affidavit saying he actually served a document on you while you are out (get proof of your whereabouts) he is guilty of perjury, an offence under Section 1 of the Perjury Act 1911.

Contact police and show them the document and ask they investigate. Its a criminal offence to make false representations like this. If the police fob you off with its a civil matter then write down the police officers name & rank and contact the IPCC, its an offence to conceal a crime under the pretence it is a civil matter - its called Perverting the Course of Justice - Section 4 of the Criminal Law Act 1967

Forget about perjury, false representation and perverting the course of justice. :rolleyes:

 

If the notice left didn't state a date to appear in court, this probably relates to a no bail arrest warrant for the person cited. Don't mess about, contact the warrant officer or the court concerned and arrange to pay the fine!!

This is actually quite simple.

 

If your partner had moved address and had not received a copy of the summons then she needs to file a Statutory Declaration in the morning.

This will cancel the fine and all enforcement will have to cease.
