    • Hello, Following the submission of my defense, last night I received an email from DCBL indicating that the claimant intends to proceed with the claim (I've attached a screenshot of the email for reference) along with the N180 directions questionnaire. I'm unsure how they obtained my email, but I suspect it was through the courts' form when I completed the Acknowledgment of Service. This email almost slipped my attention. I have also today received a letter from court to state they have received my defense.  It appears they are requesting an online telephone hearing with the court.     • Default Amount £9237.88, all this started in 2006 Admitted debt £9075.65 Weightmans added £1515.01 immediately they became involved, no explanation The Statement shows when Marlin bought debt in May 2011 £10439.25 Their statements, not received until the SAR, are based on this. Cabot deducted £1515.01on their statements in January 2019, again did not find this out until SAR. Weightmans added in  2007 after the CH1 etc was confirmed by the court £741.50, made up of Process server fees, Court Fee (they tried for bankruptcy), Solicitors fee and Land Registry fee. Unspecfied Legal costs were added by Marlin in March 2015, again I did not know this until statements received with SAR I had been paying monthly, without exception until December 2018. I am minded to take the property charge, CH1 amount ,deduct all my payments and the subsequent fees, and request/demand a refund on the final payment made? I consistently disputed Weightmans balances, but they never responded. I also told Mortimer Clarke/Cabot that I disputed their amounts.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone,

 

I thought I would start my own thread, after a week of research I have decided to take this matter further with Welcome Finance.

A week ago my car broke down, I thought it would cost a fortune to repair and as I have had the car over 2 yrs,(bought for £5000 Sept 2007) I thought about getting a new one.

 

I tried to ring Welcome with the number I used 2 yrs ago, to no avail.

I looked on their website, to which they say, they have made some changes to the company?? (They are not providing car finance to new customers....that made me wonder??)

 

I rang and spoke to someone who informed me that because they couldn't upgrade me, I could VT the car as i was over 2 yrs into a 48 month agreement. I may have some outstanding amount to pay and the VT would go down on my credit file but they could put a note on my file to say that I was VT'ing because they couldn't upgrade me!

I was advised to do this by the person @ Welcome finance, I was told it would save me a fortune!!(Not like them to give this kind of info away) they also informed me that I may have been mis-sold PPI.

 

The nice car salesman from the local dealer where I got my car from NEVER informed me that PPI was optional and in fact he told me that I HAD to take out the insurance in order to get the finance.

 

The person I spoke to @ Welcome told me to fax head office (giving me the address and fax number....I didn't send a fax, as needed to look into this)

 

The day after, I had a very desperate phone call/message left on my mobile also @ home, from my accounts manager.

I rang back the day after to speak to the manager,(who was away from his desk...he rang back 5 minutes later from a mobile number??). He insisted I do NOT VT my car, that this would go down on my credit file and I would find it hard to get credit again....also that I would definitely have liability and would owe lots of money......to which which my reply was "so your advising me to keep the car. Even if my credit is affected you can't upgrade me, so what am I supposed to do??

 

I told the acc manager i hadn't decided what I was going to do with the car yet, but I am going to look into the mis-sold PPI, to which he said I should.

I faxed the compliance dept a day later, with no reply from them in 4 days.

I am now going to send a recorded delivery template letter (stage one) from moneysavingexpert.com.

 

If anyone has been in the same situation your comments/posts or advice would be greatly appreciated.

let me give you the correct version

 

if you have paid more than half of the agreement, you can terminate with out ANY outstanding ammount

 

your credit file would only show as a closed account and SETTLED

NOT A VT

 

THEY WILL SAY YOU XYZ SHORTFALL ON THE INSURANCE, I DOUBT IT ONCE WE GET THE REBATE

 

better still

 

claim it all back

Hi thanks for the reply postggj.

 

I have contacted the local trading standards/comsumer direct today who didn't really give me any advice other than to say send the letter!!!

Although she did say that I may find it hard to prove what was said 2yrs ago.....as telephone scripts may not have been kept...this was mis-sold verbally on a car supermarket site....I was never given any info about the policy other than I had to have it to get the car??!!

 

Do I need proof of what was said??

 

I have done some calculations and I have paid just over half of the whole loan. (So my account manager wont be very happy when i send the VT letter after christmas...) Are the monthly payments paying back the PPI first?? With a small amount being taken for the car? Or does it all get paid off the car first?

 

My stage one letter was sent today anyway recorded delivery so lets see what they have to say...ill be posting back to let u know.....

A little update, they must have received the letter I sent, as I have had messages left from a recovery company who want me to contact them regarding the collection of my car.......(thats funny Ive not even sent the V.T letter yet....maybe their mind readers??!!)

 

Not had a chance to contact them back yet....

 

I'm wondering if it is a kosher company or if its them in disguise trying their scare tactics???

Hey all,

 

Sent recorded mis-sold PPI letter, letter from welcome received, not acknowledging my letter of PPI, but instead sending a termination of agreement letter.

 

I have not sent a termination of agreement letter.

 

I have concerns about the date on the letter this is dated a few days before i sent my PPI letter....backdated or......

 

Mmmmm stage two me thinks????

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

I have been reading the dead and buried thread :)

 

I have been looking at my paperwork over and over....(how I did NOT spot it b4) The agreement I walked away with has NOT been signed.

 

I recieved a signed one in the post about a month after!!!!!!!!!!!!

 

Letter recieved from WFS(Unsigned) acknowledging receipt of £11 for S.A.R (No mention of CCA)

 

Letter recieved (Unsigned) reguarding PPI "We are keen to ensure your complaint is handled fairly......Blah Blah Blah....We will issue a final decision within 8 weeks from the date of this letter( I dont think so....time is a ticking from the date of MY letter).

They have however sent back S.A.R (incomplete methinks????) Wfs have sent this recorded, but it was NOT signed for.

Ive been looking @ CRA, HP is recorded as 49months instead of 48?
