Hi there

 

Two questions really, if someone could help, this is in refernce to a store account

 

1. With store account, are they different from normal debts, as when i shopped online at this store, on checkout they set me up with a store account straightaway. I don't think I signed any agreement

 

2. I sent this debt company last Friday a SAR request asking for the signed agreement, but recieved a 'postcard', asking that someone will visit my property. Is there a template I can use to say I do not wish this and please send me the agreement, if I did sign one

go to template library on this site..... u r looking for DOORSTOP visits its there and send it

 

it works trust me...

 

then send them the cca template letter and a £1 postal order

Did you tick a tick box online agreeing to there terms ?

If so this counts as a signed agreement.

 

You have got a little ahead of yourself with the SAR. First you should send a CCA request together with a £1 postal order, recorded deliver to the debt collector dealing with this.

A SAR will not stop them demanding but a CCA will stop them untill such time they produce an agreement. Remember if you ticked an online tick agreement then this will stand up in court.

 

 

You can send this letter regarding the doorstep visit.

Dear Cretins

 

I have duly noted your intention to authorise a collector to visit my home.

OFT rules and regulations clearly state that you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you. There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.).

 

Therefore take note that I revoke license under Common Law for you, or your representatives, to visit me at my property and if you persist in sending “doorstep callers” to my home, you will be reported for harassment and be liable for damages for a tort of trespass. You would also be liable for conspiring in a tort of trespass by acting in defiance of my instructions and sending someone to visit me nevertheless.

 

Should it be necessary, I will obtain an injunction.

If anyone should ignor this and visit then you should be aware that they have no powers, they are not bailiffs and cannot enter, remove goods or any of the wild stories they may feed you. They can simply be told to go away just like any other unwanted visitor. If they refuse then call your local police station and report it. (via the police local number not 999)

I don't remember a tick box, but it could be there as that is common pratice, bit cheeky for it, with store account, i thought you had to sign it.

 

Anyway, already send them the 1 pound postal order last week, so lets see whats happens
