DLA disregard

Hi here, i have recently been awarded high rate mobility and low rate care for my dla. this morning i recieved a letter from my council saying i now have to pay virtually full rent and all of the council tax. I thought that both parts of the dla were classed as disregarded income and would not affect my benefit this way. It only says on the letter that £18,65 is disregarded but all the rest of my income is counted including the £49,10 higher rate mobility.

 

Can this be right ?

 

I have just finally got my finances sorted out because of my health and now they have put me nearly £700 in debt for back payment with them for rent and council tax and want me to pay the rest in full, which now makes me worse off than i was before i even started my dla claim.

 

If anyone can clarify this it would be much appreciated, i dont think my health can take much more upset mentally and physically as they seem to keep wanting to do.

they are WRONG get onto the Councils head of benifits and ask why they are acting unlawfull

 

half the problem most councils outsource the HB/CT to idiots like Capita and they are useless

 

also get hold of your local Councillor and ask him to investigate it urgently

Thank you for your quick reply, i thought what they sent me was wrong, but with my mental and physical state so fragile i just broke down because i can't cope with things like this, sad i know but it's been a very tough year for me and things just keep going from bad to worse thanks to people like the council.

 

Of course it's the weekend now so can't speak to them till monday which i will do first thing, as well as speak to my social worker and my welfare rights officer because they can't keep getting away with doing things like this to people, surely they must realise the hurt and damage it is doing to people already in low health.

 

I really do appreciate your quick response, means i can breath a bit better during the weekend knowing that they are in the wrong.

They are wrong. DLA is disregarded. Have a look at this site and do a calculation.

you can have a quite weekend now

 

welfare rights is a good idea they should sort it

 

but make a complaint to your Councillor, and tell him because its so serious what they are doing , which could border on FRAUD by them you want it to go to the Ombusman

I had a similar issue with our benefits office in that they have calculated our benefits incorrectly and are underpaying us. this is the third time they have made a mistake on our assessment in a period of 1 year. It makes you wonder how many people across the country are either being over or underpaid! Methinks it may be a good idea for me to contact a newspaper and produce the evidence of the underpayments.

Thank you both,have checked the calculations and they are indeed including my dla in their figures which is why they want me to pay everything in full.

 

I surely will have a much quieter weekend and less worrying now i know they are indeed wrong and as you said being fraudulent. I will let my councillor know whats going on as well and tell them that i want it sent to the ombudsman as you said, because this must be affecting so many people and the daamage it can do is horrendous.

 

Roll on monday, will let them know what is happening then.

I would think this is more likely incompetence than malice.

 

Ask them to reconsider the decision, and make sure you get all the arrears of benefit.
