hey

 

have had a couple of cca replys that i dont think are enforceable but having very limited knowledge of all this could someone please check them out and see for me.

 

the robinson way one looks to me like they have just printed out the t&cs and added my name and account number at top

 

the aktiv kapital one is just a statement - not a contact

 

whats my next move?

Pegasus,

send a reqest letter but include that you do not require a copy of an application form as sent but a copy of your original credit agreement which must contain all the prescribed terms and be contained in a single document section 60(1), if they reply with a edited copy asking you to confirm your signiture dont !!

It is clear that the documentation you enclosed is not a properly executed credit agreement. You will know that in the absence of a properly executed agreement the alleged debt cannot be enforced.

 

This matter is therefore at an end and I do not expect to hear from you again.

In the circumstances, no further correspondence will be entered into.
