Barclays have charged me £1800 over 6 years in charges and I sent them a letter stating that I want it back. The account is still open but I have not used it in 2 years. I left it open because I thought I would not be able to claim if it was closed.

 

When I stopped using the account the balance was 0 but now its minus £106 due to them applying charges after charges. I was unaware as I had moved and I did not move the Barclays account to my new address. I noticed on my credit file last month that it says 4 months in arrears all of sudden from nowhere!!

 

I have sent them the letter like I said asking for my charges back under hardship. As I am very in debt and having problems with my bills and what not.

 

The first letter I sent they said they did not know my account even though I put the account number, I think maybe because I put my new address at the top of the letter?? I am not sure but I am sending it back tomorrow stating the account number again and the address that it was with.

 

What should I do about the £106

 

When I asked them they said I have a carrear development loan with them from 2007 when I took the Computeach course. I said I canceld it with Computeach as I felt they conned me out of £1800 for 2 books that were worth about £40, they did not even send me all of the books that I needed. Anyhow so Barclays want the £1800 and I got nothing for it and they said they kept charging me £8 everytime there standing order bounced. What should I do now?

 

I am not avoiding it I just found out and was wondering what my next move as I want to avoid a default for £106 but I feel its wrong that I would have to pay them that back. But once they receive the letter from me saying I want my charges back they may default me in spite.

Can I just clarify so we don't start off wrongly.

 

1. You have an a/c which had £1,800 in default charges over the last 6 years, which you want refunded. You thought the a/c was left at zero but stopped getting statements when you moved.

 

2. The CDL for a Computeach course, which you say you cancelled, meant that the SO which was set up continued to try and take payments from the first a/c. You have been charged a further £106 for failed SO payments on the first a/c.

 

3. You say you cancelled the CDL but I'm not sure if you were able to do this, or whether it was, in fact, cancelled at all. Is the bank saying you still owe £1,800 on the CDL.

 

Can you confirm if I've got it right so far.

 

4. When you made a claim for refund of charges under the Hardship rules, did you enclose a Budget Planner setting out your current financial position and a SOC (Schedule of Charges).

Hi there. Right here is the information you require.

 

1. Yes they charged me £1800 in total including interest. I left the account at £0 when I moved and no longer recieved statements as I had moved.

 

2. I signed up for computeach in 2007 but shortly after the dust had settled I noticed that it was a con and told them I wanted to cancel and that I did not want to take part in the course. At this point all they sent me was nothing! They argued for ages and said ok. I was not aware that they took the money from Barclays and yes stupidly after signing the Barclays loan stuff some months back. I should have thought that Computeach might lie and I should check with Barclays that it had been done. But I was annoyed with Barclays at the time and did not want anything to do with them.

 

3. 2 years later I found out from checking my credit file that all of a sudden Barlcays had appeared on my account and it was not there last month as I check my file a lot on credit expert. It said 1 month in arrears and a balance £106 then it said 2 months 3 months and now 4 months all in the space of a month. I rang t hem up asking what the hell they said my repayments had started for the CDL a few months ago and they keep trying to take the money out of my a/c and because there was no money each money they were charging me £8 per month to my account. I tried to explain to them but they said we want our money back we don't care if computeach did not give you anything in return. I can understand as its not there problem they just want the money back.

 

I called Computeach and said what the hell and they said they have no record of me asking to cancel they dont record calls, I knew I should have wrote a letter this was in the day when I was stupid with such things. So I said can I do the course then as I might as well if I cant get a refund as I paid £1800 for a MCDST course and it does not cost £1800 more like £200 in total including books. They said no sorry time is up but I can pay again!

 

4. I did not include a budget planner just the letter. I am going to resend the new letter tomorrow can you show me what I need to include as well then please?

 

My account is close to a default I want to avoid this should I pay Barclays the £106 then. Even thought im on a tight budget and my baby is due next month!

Hi Neolight,

 

I'm sorry to say you're stuck with the CDL, even though this course was useless to you. Even if you cancelled in writing at the time, I doubt you could have got out of the contract so you would still owe the money anyway.

 

If you want to avoid the default, you'll have to pay the arrears and keep up all future payments to service the CDL, IMHO. :(

 

If there's an alternative course that is useful to you, you may still be able to negotiate on this matter but these courses and the way they're run have been heavily criticised.

 

After the Supreme Court ruling today, it's too early to say if you can reclaim the £1,800 default charges on the bank a/c. There's still hope but keep an eye on Forum announcements for confirmation on this.

 

The Hardship aspect of your claim will no longer be affected by the FSA Waiver which has now been called off.

Hi Neolight,

 

To clarify the above, although the FSA Waiver is now ended, hardship cases should still be looked at sympathetically where customers are experiencing financial difficulties.

 

Watch the forum announcements at the top of the Forum pages. There will be new advice on how to best proceed with charges claims within the next week or so.

Neolight have you got your statements to show all these charges ?
