Hello.

I am being asked to accept a change in my T&C of employment; this change is to have my weekly pay paid on a monthly basis. I am contracted to be paid weekly and have disagreed in writing to this new term but they insist that this will go through regardless. This new term will impose serious financial difficulties on my part and my duties within this company will be affected

I am in continuous employment with them for the last three years

Would it be possible to resign and claim constructive dismissal or would you advise me on another route

What I would do is sit down and itemise exactly why this changeover will affect you.

 

Write another letter to your employer, explaining why this change will cause you such hardship. Emphasise that you've been a long serving employee, and that your circumstances are such that this change will cause real hardship to you.

 

Propose that you have a meeting, and request your employer provide you with a degree of assistance in the first month.

 

I can well understand, I've been in exactly the same situation myself when going from weekly to monthly pay in different jobs. You wonder how you're going to survive through the 1st month. It's not at all easy if you've no savings too fall back on.

elpulpo is right. You are unlikly to be able to stop a variation of this kind if it is in the buisness interests and they have consulted you and given you notice of the change (at least one week per year you worked there). Constructive dismissal is very hard to prove and complete non-payment has been found not to amount so I would be wary. Although you could use it as leverage in the discussions elpulpo states as long as the costs would prohibit you from working to a certain extent.
