CCA Agreements

Hi,

My wife previoulsy took out a loan with her ex for £44k in July 03. When she split with her ex it was agreed that he would continue to pay this. We have just recd a letter stating that she owes £16.5k.

From what info I can gather this loan was probably mis-sold at the original outing.

As this was before the CCA2006 is this enforceable or what can I do to get copies of the original agreement? Also is there a fee with this?

If her name is on the agreement then send the creditor a CCA request from the CAG library on this site and enclose the £1 fee.

 

When she receives it [12 days +2 days from the creditor's receipt of it] remove all personal details and post it on this thread for advice.

 

In the meanwhile why not post up the letter she has just received after removing personal info.

As the loan was over £25k and drawn down before the removal of the financial limit execption. The loan is not regulated by the CCA.

 

Instead of a CCA request as suggested, I would advise a subject access request under the Data Protection Act 1998, which will cost £10
