    • Our price is the same all day, but varies day to day. Yes there's a risk of high prices but it has never gone above SVR any time since I signed up. Last 30 days average 17.67p/kWh, max 20.67 and lowest was 11.83.  It saved just under £300 during 2023.  
    • It you had E7 in the past but have converted to single rate then the meter will still hold the last recorded Night readings. This introduces scope for error when manually reading. If the meter has only ever been used on single rate then there's only one figure that can be taken. For example ours shows "Rate 1" reading and a "Total import" reading, but they both give the sme figure. If it has ever been on E7 the total will be higher, including the retained night reading.
    • okay, perfect and thank you so much for the help once again. so firstly i am going to initiate the breathing space, during this time it's likely ill receive a default. when i receive the default are you aware of how long it will take for me to know whether the OC have sold it off to DCAs? Once it's with the DCAs i do not need to worry as they cannot issue a CCJ only the OCs can Even if i decide to come an arrangement with the DCAs no point as the default will remain for 6 years paid or not paid I should only consider repayment if the OC still won the debt and then issue a CCJ? Just to confirm the default will not be seen after 6 years? No one can tell I had one then after 6 years ill be all good?
    • I'm not sure we were on standard tariffs - I've uploaded as many proofs as I can for the ombudsman - ovo called last night uping the compensation to 100 from 50 pounds for the slip in customer service however they won't acknowledge the the problem them not acknowledging a fault has caused nor are they willing to remedy anything as they won't accept the meter or formula was wrong.   I'd appreciate more details on the economy 7 approach and I'll update the ombudsman with any information you can share.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hiya MKB,

 

Carry on fighting for the PPI and I would inform the FOS that they have terminated the account before issuing a Default Notice.

 

Send The FOS copies of all the docs you have posted here and state that under the circumstances any PPI refund is due to you and not the Co-op.

 

OK will do.

Chuckle of the day I think :D

 

Got a red, hand-written envelope today with a card inside. Nooo, not a late Xmas card but a good attempt at looking like one! Shame they still have the a/c in my maiden name cos it gives the game away before I have to open it :lol:

 

Anyway, here it is in all its glory!!

 

So, if they turn up, I will take great pleasure in telling them to go forth & multiply (not very ladylike I know but very satisfying :lol:).

Just re-read the card & noticed the bit about additional costs. They're not allowed to add costs are they since the a/c has been terminated, albeit unlawfully?

Nope, not unless it is expressly provided for in the original agreement:D

 

I would drop Power2Contact a shortish note saying..

 

This account is in dispute and is currently being investigated by the Financial Ombudsman.

 

Your communication is also in breach of OFT guidelines.

Thanks CB. The card however, came from Co-op & as yet, have had no comms from P2C so I will do nothing unless/until I hear from them.

 

Am also guessing that the a/c has not been sold to P2C since co-op have not told me that it is by way of a notice of assignment so if P2C claim that they have bought it, I will enjoy writing to them :D

I am absolutly amazed how a company as big as the co-op still get it wrong oh and the card u had treat it with a bit of salt no one will call at your home i have had a few of those and nothing cane of it except a phone call which usually comes a day or two later and if they do just quote Fos ref number

i would be inclined to add to the letter:_

 

on no account whatsoever will i discuss this matter with personal callers, make any payment of any kind or even confirm my identity, therefore if you wish to waste your resources sending people on wild goose chases the costs will be for your account

 

 

 

(this can be shown to a court at a later date to remove any added chagres since you made it clear there would be no point in their visits)

FOS letter today says co-op will settle PPI complaint!

 

What then should happen given the farce that they have made of all this?

 

Not paid since July 09 so a/c technically in arrears (if it still exists) but the settlement should be bigger than the arrears but how do I get the extra portion cos all I can see happening is that co-op will refund themselves & will chase me for the reduced balance even tho they unlawfully rescinded the agreement.

 

Oh, I am sooooo confused :confused:

The Co-op should write to you and say and give you a breakdown of their plans to refund. You will almost be asked to agree to whatever evil plans they have for your dosh.

 

I imagine if there is a balance due to them, they will repay that first and then send you a cheque for the balance.

 

I am not sure whether Pompeyfaith has been paid out yet ?

I really don't know whether to laugh or cry at the total incompetence of co-op bank :eek:

 

So an a/c unlawfully rescinded back on 17/11/08 despite no DN which then follows, dated 1st Dec for remedy by 15th.

 

Acceptance of unlawful rescission posted 30/11/08

 

Next is 'we've asked power 2 contact to contact you' postcard - ignored.

 

Today brings .......................another TN!!!!!! :eek:

The FOS have found in my favour re PPI complaint which, when refunded to the a/c, will clear the arrears so I think it may be fun after cos I would actually have a perverse pleasure if they decide to take any further action against me to enforce the a/c - maybe that proves that I'm a complete nutter but it also says that once empowered with the correct legal knowledge, there is no reason to be bullied by huge corporations into parting with our cash when they have lost their entitlement to it by virtue of their non-compliance with consumer law & customers rights.

similar me

 

the application for strike out of the claim- if it comes will be VERY simple

 

 

if they issue a claim- make sure you file an embarrased defence then a CPR31.14 and then write to them offering them the opporuntity to withdraw without costs

 

if the fail THEN make the application to strike out

 

the filing of the defence (albeit a holding defence) will fillet their donkey in respect of trying to issue fresh proceedings IMO

Despite being emailed the 'you have no right to be on my property' letter, P2C turned up!

 

They then proceeded to tell my OH that he was here to facilitate a phone call between myself & Co-op bank!

 

OH called me to the door where the C2P guy repeated all of the above. I told him that I refuse to speak with Co-op but if he would like to ask co-op to send me something meaningful instead of the drivel I've had so far then I might deem it worthy of a response. Oh & BTW, tell them to oblige with the FOS recommendations re PPI.

 

His response to that was they have only 2 options to report: either agree to speak with them or refuse.

 

He left here under no illusion that I would speak with them :rolleyes:

 

Questions: are they allowed to visit when expressly told not to & are their actions against the spirit of the OFT guidelines for debt collection? If yes to both questions, what should my next move be?

well IMO you can waste energy on winning battles- or save it to win the war!

 

if you were traumatised by the visit you could complain to the OFT

 

it is doubtful you would get anywhere though, unless they continued to call (which they wont )
