    • Beware using the word "mitigating". That is only if you're admitting it and asking them to be lenient because x,y,z or whatever.   You are not admitting it so there can't be anything to mitigate something you didn't do.
    • pop up on the MCOL website detailed on the claimform. [if mcol is not working return after the w/end or the next day if week time] .  register as an individual  note the long gateway number given  then log in .  select respond to a claim and select the start AOS box. .  then using the details required from the claimform .  defend all  leave jurisdiction unticked  you DO NOT file a defence at this time  click thru to the end  confirm and exit MCOL. . .  get a CCA Request running to the claimant https://www.consumeractiongroup.co.uk/topic/332502-cca-request-consumer-credit-act-1974-updated-january-2015/  leave the £1PO blank and uncrossed . .  get a CPR 31:14 request running to the solicitors [if one is not listed send to the claimant] . . https://www.consumeractiongroup.co.uk/topic/332546-legal-cpr-3114-request-request-for-information-when-a-claim-has-been-issued/ . . type your name ONLY no need to sign anything . you DO NOT await the return of paperwork. you MUST file a defence regardless by day 33 from the date on the claimform [1 in the count]  
    • Could you perhaps use the quote button so as to minimise confusion?  It's difficult to distinguish between what you quote and what you are saying.  (Actually it is quite easy to tell the difference).

Vanquis, no acknowledgement of the dsar/ sar, they have however sent me their terms and conditons, fact sheets, along with 2 computer print outs of my details. I think they were considering it the CCA. -       lowells sent pap, replied, they sent again, replied again -       Court claim

This is quite scarly but have posted my letter to Lloyds today requesting 6 years back statements. Cannot wait to find out their response. Hopefully I will get a response in a couple of weeks. Used the standard letter. Have read all your responses and fingers crossed. Not sure how much they have charged me but it is quite a bit. :shock:

Someone else had the same response to the request. My reply:

Could that be a stonewall tactic - I was led to believe from other threads that the clock starts ticking once they have received the money. This sounds like a catch 22.

 

However, you have made the request - did you get a confirmation that the request has been accepted?

 

I think this should be monitored as it could well be a 'get out of jail' tactic by the banks...

as you can see from my thread, my branch has had my reminder letter and my money by recorded delivery and they haven't banked the cheque yet!

 

Am going to ask for copy of the signatory to back me up further seeing as they may be stonewalling.

Hi - nice to see you all reading my profile. Spoken to the Bank again today. They are prepared to debit my account. I will keep you posted. Also spoken to Halifax who I am also doing - they charge £5.00 and would be happy to do it over the telephone!!!!! Said I would write letter!!! Will be interesting to find out if they are "stone walling" as you put it. Will keep you posted on the date of their response. They must be getting inundated with requests and if they havent cottoned on yet, they soon will!!!!

Just to keep you in the loop - my statements arrived today. Had a quick look before work - looks good to me. Had no problems - ordered last week and payment via debit as requested. No problems. Now the hard work begins tonight - taking highlighter pens home today!!!!! Will keep you updated.

"I note in your letter that you mention manual intervention on your account. I would be very grateful if you could clarify what is meant by this and what information you require. If this relates to the application of charges to your account or the returning of items etc, the sytem automatically decides on what is returned or paid and applies the relevant charge to your account."

 

Help - bank nonsence to me, but I think it relates to the 1st letter - the last paragraph. Can anyone help.

Quite interesting that they are actually admitting that it is "the system" that does all the hard work. Are they paying "the system" 35 pounds? Tut

The last paragraph is in response to a request to know if human beings had been invovolved in the imposition of charges.

Just read some other peoples threads - they have received the same letter as I have today.

Guess what - yes from David Just - he must be a busy man.

 

Cannot recall the next action though - do I wait until the 14 days I gave them in my first repayment letter - or now because they have replied to that letter - send another letter giving them another 14 days before court. Not sure which way to go.???

14 days after the LBA go to the moneyclaim site and commence action. There is a template for filling in the claim in the library.

Not sure what it means so if anyone can enlighten me "acknowledged" does this mean they are going to defend???:-?

You should get a letter from moneyclaim telling you whether they have acknowledged accepted full or partial liabillity or whether they are going to defend the whole amount. If they are defending they will then have a further 14 days to file their defence.

 

If they don't file whithin 28 days of the issue hit the judgement button:D :D

Called a Response Pack Lloyds are defending whole of the claim - Martineau Johnson - their solicitors I think. Do I do anything???

 

Can anyone now tell me the next stage - I believe I receive something which I then need to fill in and send back.
