Right, having gone down the SoGA route I've already gone through the process of sending a technicians report along with the SoGA letter to Empire Stores allowing them to reply within 14 days, which they did.

My problem is their responding letter just refers me back to Sony. Are they just giving me the run around?

Do I phone Empire Stores or do I continue correspondence with letters? What do I say or write? confused-smiley-013.gif

I'm still learning about sales of goods but I would be of the impression that even though it is 2 years old, it should still be working.

You won't be able to get a replacement/refund but you should be able to get it repaired or a discount on a newer model if the cost of repair is unreasonable.

 

I would be quoting section 14 of the Sale of Goods Act 1979 (amended in 1994) which states that goods have to be of satisfactory quality.

There is also the Sale and Supply of Goods to Consumer Regulations 2002 which may help.

 

As you have an independant report which states a manufacturing default it is down to the retailer, not the manufacturer to address the issue. They sold it, they deal with it.

 

A reasonable test of durability is the initial cost of the PS3. Higher priced goods are expected to last longer than cheaper products.

I don't think 2 years for a PS3 (unless you have chucked it around) is long enough.

Just to update, Empire Stores are sending a cheque to cover the cost of a refurbished model direct from Sony. Probably the best I could hope for. :-)
