    • I've looked through all our old NPE threads, and as far as we know they have never had the bottle to do court. There are no guarantees of course, but when it comes to put or shut up they definitely tend towards shut up. I look forward to your deafening silence.   That should show them you're not afraid of them and draw their attention to their having legal problems of their own with the SAR.  If they have any sense they'll crawl back under their stone and leave you in peace.  Over the next couple of days invest in a 2nd class stamp (all they are worth) and get a free Certificate of Posting from the post office.

    • Okay please go through the disclosure very carefully. I suggest that you use the technique broadly in line with the advice we give on preparing your court bundle. You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? Also, I think that we need to start understanding what you have lost here. Have you lost any money – and if so how much? Send the SAR to your bank as advised above

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

There is one things which DCA's are afraid of...

 

 

One observation I made based on my numerous phone conversations with various banks collection departments and DCA's.

 

They are afraid of their phone calls being recorded.

 

I have a truecall unit installed and recording all the conversation (best 100£ I ever spend, on one of credit cards without CCA :) )

 

I also gave a 0871 number to all the DCA's and banks. I can at any time change whether all calls to this 0871 number are transferred to my home line or to voice-mail or whatever. Hence I basically can take (or not) phone call from DCA's as I please. Lately I do sometimes take their calls just for fun of quoting legislation and case law to the monkeys on the other end as well as referring them to specific paragraphs of letters I've sent them half a year ago and observing their reaction.

 

Usually when I grow tired of a pointless discussion with a low IQ idiots who unable to maintain an intelligent conversation I tell them 'ohh by the way I am recording this conversation'. Every time, without a single exception, they hang up or put me on an endless hold within 30 seconds after that.

 

I do not mind being on hold, due to satisfaction knowing that they pay 10p per minute. (google 'free 0871 number' or something like that if you want get such service for free, you actually could get paid 2-3p per minute of calls to such 0871 number)

 

Conclusions:

 

1. They know that they act unlawfully when they call and bamboozle you with waffle and they are trying to avoid any paper trail on this.

 

2. If you want them to hang up, tell them that you are recoding, even if you don't.

 

3. Do not talk with them unless you are recording.

You dont need to folk out £100 on that thing to make them believe your recording. Just tell them you are and it works just as well and is £100 cheaper.

 

True, but transcripts of all that drivel they tell you might well worth weight of this truecall unit in gold.

Do you have to tell them you are recording a call, and if they say that you can't, how can you bamboozle them back with legislation?

The DCA's make laws up as they go along.

Its a culture shock to them when they are forced to comply with real laws :rolleyes:
