      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have an interview with the police on Friday with my friend who is a witness in my case,

I am putting my case forward with evidence I am using as part of my case of the theft of my car by LBL. I'm taking in all the BOS paperwork about the true owner at the time of the execution of the BOS. I am throwing the lot at the old bill and a wonderful bit of legislation that makes the attending police answerable to charges for allowing LBL guys to take the car. So putting the pressure on big time.

Oh and this interview is a police complaint for taking no action on the original complaint when the car was first taken by them.

So this time they have to take it seriously.

Hopefully this time it will be put down as theft.

If not I will complain about the CPS, I will keep going until it is given the title it rightfully deserves THEFT of a motor vehicle. That will look brilliant on the paperwork for their appeal hearing wont it.

Hi, how did your interview go last Friday? Have they now accepted that your car was stolen by Log Book or do they still hold that it is a civil not criminal matter?

 

Interestingly as you don't say previously, was your uncle the barrister, able to advise you (at arms length obviously, being related), that it was a criminal matter as far as Log Book Loans is concerned irrespective of the police presence?

Hi,

 

The interview had to be canceled last min by my friend being caught up with work commitments it is being rebooked this week will keep all up to date when new appointment is dont worry you guys will be told. I do know how important this matter is not just to me but to a hell of olot of people.

Don't think that the cash cow is dead just yet,

But Companies House have I now believe taken on broad what has been said at the hearings and looking into the whole company.

Hi All,

 

I had my car taken by Anglia UK on thursday in respect of a loan I had with Log Book Loans. I had been in touch with them to try and negotiate a reduced weekly repayment, however they were refusing the figure. They said they will hold the car for 14 days and then sell it on. If they have had their license revoked where does that leave me? I don't know if the BOS was even valid. Please help!!

Your very funny!!! Ive had the same,but they took my Disability Carriage from a Disabled Bay outside my house.I called the Police and they turned up with guns because one of the Bailiffs when he called Police(as he knew I already had)shouted out to my carer "Go get a weapon, go get a gun"The Police now realise they were used but my home was searched twice,and the Police actually handed my car keys to Templar Besoke.The Bailiffs came at 5am on a Sunday morning(totally Against CSA regulations,Bailiffs cannot operate on Sundays,Bank Holidays,and only between hours of 8am and 9pm.A District Judge Ordered my Disability Carriage to be returned "Forthwith".It was returned by asif hussein of Orange.I had to call Police again as car was filthy but most of all,it would not start.It was totally drained of fuel(diesel) obviously done purposely as electric fuel pump was also empty!I am now taking nine regions,and Templar bespoke Solutions to Court to get recompense for all damage.(my tool kit was also missing-Icall that theft-the Police call it a civil matter.It is also a Civil matter that my carer was assaulted!Its an absolute joke,but if we didn't laugh,we would cry!!! I believe in Karma and it always takes care of things,more than you will everknow!!! keep your chin up and keep fighting the buggers!We will win in the end.from.Sarah
