dd, were you aware you had to attach an exhibits page to each exhibit as below : Obviuously you will need to amend defendant/claimant where necessary..

thanks citb yes i copied it from a response you made to someone else

 

plus then a list of exhibits as well i think?

 

If this was exhibits for an application I dont think its needed, I put it in my trial bundle for a hearing but not for my cpr 31.16 application, although I suppose it depends on the number of exhibits ;-)

its a strike out application based on a faulty DN (well faulty) but have included as suggested by PT the 127(3) on the CCA and the prevention of enforcement due to non compliance with s78

 

basically then the whole of my case really

 

are you saying that i don't need any exhibits (there will be around 15 in all what with letters etc) with a strike out application? (apart obviously from the DN and alleged agreement? or just not the list of exhibits

Note the highlight :-D, I was talking about the index ONLY. If you refer to the exhibits in your witness statement/application then you must provide them with the application.

senior moment!! yep there are only 14 exhibits and the court will probably only refer to 2 or 3 of them

its taken me ages to get the strike out application listed due to shortage of judges in local court

 

listed for next tuesday and nationwide have discontinued

 

thats a win then!!

 

Oh well done, congragulations. Title amended.. now what about costs:)
