    • Holding my hands up I was a naughty boy driving a transit van along the A55 in Wales in February and exceeded 60mph in what I thought was a 70mph zone. ( all to do with the weight of the van). When I realised the error of my way I took the fine and sent my licence off by Royal Mail. Yesterday I received a letter from North Wales Police saying that I was now being prosecuted in court for failing to surrender my licence. I paid the fine as soon as I received the £100 penalty letter and carefully read the form ( which is confusing to say the least) and immediately took a walk to the post box and sent my licence off. In hindsight I’m a fool for believing that the licence would get to the HMCS in Loughborough without the need to track and trace the letter. I still believe that Royal Mail hasn’t lost the letter with my licence in it as I have never had any other letter go astray. I believe the licence is with HMCS it’s just not yet been processed probably due to Covid backlog. Seems Covid is to blame for everything these days. How can I avoid this going to court? I’ve never had a speeding ticket in over thirty years of driving or any other ticket hence why I was keen to comply with the ticket and send my licence off as instructed.
    • Rejection letter to be sent to the FOS   I am declining your decision of 13th April for the following reason:   Much of your decision is predicated on your view that Aviva had a “process” in place and that they follow this process and as a result the decision to enter an insurance contract in 2015 was fair. 1.      Nowhere in your decision have you explained what the process was and whether in fact the process was fair. Clearly your view is that regards of the process, all that was needed was for Aviva apparently to follow this process and any outcome would be fair.   2.      On 2 June 2021 I received a telephone call from the Aviva complaint team. During the conversation, they informed me that in fact that in 2015 the call handler had been wrong and had not followed the correct process. The Aviva caller told me that it was not part of the process for the call handler in 2015 to refer her suspicions to her manager. Clearly, if the call handler in 2015 had adhered to the correct process and allowed herself to be guided by her own suspicions then Aviva would not have agreed to provide the insurance cover and they would not have become the victim of fraud. In fact that we find is that the correct process at the very serious suspicions of the call handler were overridden by a manager. It seems evident that either Aviva has misled you as to the nature of the process or else they have not disclosed their process to you. It may even be that they do not have a written “process”. They only have “a way of doing things”. If it is correct that you have not seen the Aviva process but have simply taken their word for it, then it is clear that your investigation and your decision has for the short of any reasonable standards. If on the other hand Aviva has misled you as to the nature of the process, then I think you have a very serious issue with Aviva. I believe that you have ever seen the “process” upon which you are purporting to rely on your decision. You may be interested to know that the man who defrauded Aviva also attempted to use my identity to defraud a number of loan companies. I’m pleased to say that all of them exercise sufficient diligence that they did not become victims of the fraud. Only Aviva failed to exercise proper care and allowed themselves to be defrauded. You may also be interested to know that the police have interviewed me and they have interviewed my brother and they are preparing to charge my brother in respect of his fraudulent activity. I am under no suspicion whatsoever. The police have informed me that they will be speaking with Aviva facing fairly soon. There are many other reasons why I am refusing to accept your decision. All the other reasons turn on the fairness of your decision that the reasons above, go to the heart of your own process and the quality of your investigation. I think it’s not insignificant that I have submitted a Freedom of Information Act request and also a Data Protection Subject Access Request to you and so far you have failed to respond within statutory deadlines. I have also sent Aviva a Subject Access Request and they have extended the deadline for compliance by a full two months for spurious reasons which I do not believe. I have also asked Aviva for sight of their policies and procedures in respect of the rules that they apply to their customers for the setting up of new business and I have received no response. The Aviva website makes a show of being aware of the dangers of domestic financial abuse and they trumpet their association with the organisation Surviving Economic Abuse and they say that their staff are all trained in spotting the signs. I have asked to see their abuse policy and I have received no response. None of this is surprising.    It is clear that Aviva have acted carelessly. They were suspicious but preferred to get the new business. It is Aviva which is the victim of fraud but they prefer to try and avoid their responsibility and pass the buck onto me. I’m pointing out that it is Aviva which is the victim of fraud because I can state categorically now that I have no intention of paying any of the money which Aviva is demanding of me. I notice that Aviva prefers to harass me for an alleged debt rather than simply bring a claim in the County Court where an impartial judge would look at all the evidence including information which so far Aviva has declined to disclose.   This letter is intended to decline to accept your decision but also is intended to be my formal complaint which I wish to be escalated to the Independent Assessor. Please confirm receipt of this complaint, provide me with any policies and guidelines the Independent Assessor route and also let me know the timescales involved.   Yours faithfully
    • The G7 hasn't gone to plan, has it?   Rather than showing the UK off as a potential global leader, Johnson has probably started a trade war with the EU and is being told that other nations don't trust him.
    • Hi   I assume this mattress was the Tenants own property?   So after moving out the Tenants provided an attachment showing a stained mattress and wanting full deposit back and threatening to claim against you for this.   1. Tenants failed to notify you of this stained mattress issue until the end of tenancy after they had vacated the property.   2. You have no evidence that this was the actual mattress used in that property nor evidence to back up there claim the staining caused this mattress damage.  (i.e. one of them could have had an accident and wet the bed or done this when they moved from the property).     3. Ask them that you wish the mattress independently inspected. (which you are fully entitled to do and if it proves this claim is false it will be added to the deposit claim by you the landlord for damages as well as the Garden if you need to get landscapers in to carry out the work that should have been carried out by Tenants as per Tenacy Agreement and raised  by yourself (Landlord) on a few occasions which Tenants failed to rectify even at end of tenancy.   4. Ask them to provide you with the contact details of there Contents Insurance Company (tenants whether Private or Social Housing should always take out and have Contents Insurance but is up to that tenant) bet they don't provide it Big question is the Deposit protected in a Tenancy Deposit Scheme (TDS) and those Tenants that have left were given a copy of the Prescribed Terms for that TDS? (Bear in mind you may need to tell TDS that you are in dispute with the Tenant about damages i.e. mattress and Garden)    
    • plenty of time to research and calm down. nothing much to do until the end of june.

Hi to all, I am relatively new to this site and have been reading with great interest all the various battles with banks etc and how to get these unfair charges back! Good luck to everybody and well done to all those who have been successful so far!

 

So my story with HSBC begins and I must say I am hopeful, boosted by all the encouragement from users here who have had the same misfortune as I to be charged unfairly.

 

Luckily I had all my statements so I filled out the spreadsheet and sent of my letter requesting all charges refunded, along with my wife. I posted out the prelimianary letter on the 5th August, I got a very standard letter back from them on the 10th saying 'we're looking into it'. Ok...

 

Then on the 12th of August I received a letter from Mr David L Johnson of HSBC saying I wasn't entitled to any kind of refund and an explantion that all cheque books, cards etc were all issued free and that charges were all valid and still stand. So... my next step is to send the LBA but I have a question and I really hope someone can help here.

 

I received their letter within the 14 day deadline saying no refund is due, do I still have to hang fire until the 14 days are up to send the second letter to them? I have read the FAQs and it seems to be the case, I was just wondering, seeing as I had heard already, if I could progress to the next stage yet? Oh, and my wife, who sent her prelim out at the same time as me, hasn't heard a peep from HSBC, I wonder if it is because my claim (£2,219.20) is smaller then hers (£3827.44)...? A real mystery eh? Any help greatly appreciated and received with thanks.

 

I'll keep you posted as to the progress of our HSBC fight and once again good luck to all in the middle of theirs and well done to those who have been successful!

Wait the 14 days its better this way 1) its shows the court you have given the bank ample opportunity to comply and 2) its what you stated in the 1st letter and shows that you mean what you say.

Hi there guys

Am in the same boat as you by the looks .... Sent the letter with my breakdown (as i didn't have to request my statements and all that) and got a 'we are looking into your complaint' letter the other week and then a 'we dont agree and you are getting zip' letter last thursday (just within the 14 days of sending my 'give me my money you *****ing bankers' letter to them)

 

you refer to sending a second letter - what are you thinking on the wording of this ?? what are these on-line money claims i have seen referred to instead of trotting down to the county courts ?

 

just for background - have a current account which i have been charged for going into overdraft on (usually by not much and only for a couple of days) - eg the last one i went over by £28 on a saturday and was charged £25, and i cleared the lot when my pay went in on monday........ hmmmm.

 

thanks for any help - this site is really motivating and my friends are anxiously awaiting to see if i am triumphant so i can them persuade them to do the same !!

The second letter is the "Letter before action" which you can find in the templates ection. You need to insert numbers and amend accordingly, but it's quite an easy process. Moneclaim is the online claims process that you need to complete when they don't reply to you LBA! again, there are links to it and a guide on how to use it in the templates section.

29/09/06 - Cheque arrives, FOR SOMEBODY ELSE!! with all their account details in a letter adressed to me!!!

29/09/06 - HSBC refuse to pay money back into my account

Right then, deadline number 1 is up tomorrow and I have my LBA all ready to post out in the morning! It includes extra charges too, can't wait!

 

Just checked my HSBC current account too and it seems they have banked a cheque I sent them for the DPA request on my HSBC Gold Card account! Don't they ever stop?????

Well well well... LBA's sent off Friday the 18th August, just checked Royal Mail and they were delivered yesterday. And then comes a letter today from HSBC in reply to my our joint acc prelim letter dated the 4th August. Funny that, no reply at all (I got two in less then a week for my own acc) and then as soon as the LBA's arrive at HSBC Towers we get the letter about our joint acc today saying:

 

'The bank does not agree with your contention that the charges that have been imposed constitute a penalty and are therefore unenforcable...' Hmm. Really?

 

Maybe the letters crossed over in the post but this latest letter represents 'our final response on this matter'. Well, it doesn't represnt our final response so roll on 1st September when the LBA's both expire! Yeeeehar!

Well, hello again. You did better than i did, they have credited my account with £100 "in view of the time I have devoted to my query", and told me to sod off. My claim was for £1542.00. The two weeks from when i sent the LBA was on friday so this came in right on the button. Will now investigate the MCOL business....... good luck with yours, mj

What address do i use for the bank on my MCOL ? the online system doesn't seem to like the S1 2US postcode i have used ofr my letters ??

 

I'd use their Canada Square address, it is listed on the MCOL site. I have filed my MCOL using that address but not sent it yet as funds aint what they used to be so I am trying to go via the courts using hard copies of the N1. I am disputing a managed loan with them and they won't defer payments while it is being looked at. If they had I'd have sent my MCOL on Saturday! The scumbags have cleaned me out - again. :mad: :mad: :mad: :mad:

 

So Idropped my claim forms off today for two seperate accounts (my wife and my own) and the charges are stacking up nicely as is the interest! Good for us but why don't the banks realise that by prolonging the payout they are simply having to spring for more money in the long run? I know they are hoping we'll be quiet and go away but after making me an offer they just went all quiet themselves and I ain't heard a peep out of them since the 24th August.

 

So now we are at the court stage (pending the CC looking at my request for exemption from payment as I really can't afford it thanks to you know who grabbing money when I needed it most), lets see what happens next... Fingers crossed!

Exciting times folks! Received my Notice Of Issue from the court for my claim against HSBC! It is deemed served on the 13th September and they have until the 27th to respond! I can't wait, it's getting nail bittting now! Just counting the days... Fingers crossed!

Well, I won! :D :D :D :D :D Got a letter offering full settlement yesterday! Woohoo! I did, however, sign and return without the confidentiality bit crossed out as I really don't need any more delays holding up my money! Besides, it's not too hard to fund out what I claimed....:D

 

A donation will be heading this site's way as soon as it clears into my account! A big thankyou for all the info and advice from everyone and it just goes to show you, you'll get there in the end! Do not be pushed by the banks, take the fight to them and get it all back!
