      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I hope someone can help me?

 

I have been with brighthouse for a couple of years and now trying to get rid of them

 

I have three items with this company and always pay by card before saturday or on saturday without fail

 

Today i was out so i left my husband the card details to pay the bill as usual. Today, however Brighthouse rung up and said that there card sytem was currently off so he must now come into store. My husband said he could not as at the moment he has a growth on his leg which severly effects his mobility and brighthouse are aware of this. Also this was half three this afternoon and my husband can not drive so he would have to walk to a bus stop thos is impossible as he can hardly walk twenty meters never mind walk quarter of a mile to a bus stop and catch two buses (not a chance)

 

Thier answer? get off your arse whether your disabled or not and get into store you were not that disabled to sign the agreements!!! My husband has not ever signed agreements with them because he can hardly ever manage to travel that far

 

They now expect now when thier card system goes back on line they want two weeks money plus all the late charges even though due it was due to there error i was unable to pay.

 

what can i do about this as i feel i should not be treated like this and it left my husband really upset

Unfortunately yes they CAN do this... :mad:

 

It is, of course, very bloody minded and not at all in keeping with the company's "putting the customer first" ethos of late... but, hey, this IS BrightHouse we're talking about here...

 

I would suggest that, if you have a good payment history and have been making regular payments by debit card for some time, contact their customer services and tell them the situation.

 

Your store manager has absolute discretion concerning late payment charges, and could waive them if he wanted to. Sounds like a proper little "jobsworth" I think.

why did u leave it till saturday?

and they are well within there rights to charge the 3.00 fee on top as well as double for the week in front....

you use this service because your credit file is shot....you new the risks when you take a hire purchase agreement

I f you go and speak to a manager they will sort it out for you.

i am a debt expert and have been a debt colector for many companys(inc brighthouse)....

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

please just speak to the store manager (make sure its the manager as yes he does have absolute descretion and can do a re-write on your account but to all brighthouse customers .....saturday is the latest you have to pay you can pay during the week you know!

I have never been in debt and have never had debt

 

Up until two years ago i have a very sucessfull career until i became and still am seriously ill

 

so ill that i know require 24 hour round the clock care and a lot of treatment

 

i had to go to brighthouse because you should be aware that getting credit when off work is very hard to get and seeing i had never had credit before it was the only option to me

 

i have been looking through this site during treatment and here has a lovely community where people like Lefty, clemma, steve and such give really useful and friendly advice unlike you who tar everyone with the same brush sitting up there looking down on people you ahve really have no idea what they are going through

 

Thanks you Lefty, clemma etc for always excellent advice and help with debt please do not ever comment without knowing the facts first.

If the lady chooses to pay on a saturday, thats her choice. Maybe she gets paid on a saturday?

 

Its not her fault ****ehouses system was down. Its not her fault that her husband is ill.

 

Just seen your previous posts were you claim to be a debt collector. This does not make you a "debt expert" as you put it.

Agree mate, yet another troll ... sounds like the rubbish the woman at our local store says who made personal threats against my partner !

 

please just speak to the store manager (make sure its the manager as yes he does have absolute descretion and can do a re-write on your account but to all brighthouse customers .....saturday is the latest you have to pay you can pay during the week you know!

 

The manager will say "the fee's are set by head office, can not change them" As they said to me, until we outright refused to pay and complained to head office.

thats right, can pay any day you like until close of business Saturday ... if their card machines are offline that is their problem.... they are effectively refusing payment ... I bet they did not notifiy the customers that normally pay by card that the service would not be available before they called ? NO doubt it.

 

Debt collector being a debt expert, yea on a very biased side of spouting BS to get paid !

This has happened a few weeks now in the Blackpool Store, and had no problems so far in not having to go into town and pay it, they just tell me to try again later, and last week it still was not working by saturday close, so they said to ring monday and that I would not be charged late fees (actually didnt pay it till the wednesday as their system did not start working till then).

 

Just ring them up, tell them you are paying by card as that is one of their payment methods (we are all told this on signing up) and you will pay it as SOON as their system is up and running.
