Thanks to both of you,

As this is a closed account a would assume at the end of the process that HSBC's solicitors will settle in the form of a cheque? would you need to keep the claim open until the cheque has cleared? or if it did not the bank would breach the terms of settlement?

Provided a slip advising them that a delivery was attempted by the Post Office of a letter requiring a signature, then you have served the letter. Your 14 days run as from the date sent, not the date they decide to collect it.

Have you requested a trace from the Royal Mail website? There is a slim possibility it has not been delivered and if so, they can confirm this.

Its now been 16 days since my request for statements was sent to HSBC and I have not heard a peep from them, Not even acknowledgment of the letter I sent them.

Is that quite normal and the first stall tactic by dragging out the 40 day data protection act request as long as possible?
