    • Are you allowed to appeal if you plead guilty?   I know you appeal the sentence, but the criminal record formed from your guilt would surely remain?   I'm not sure if your able to appeal a crimianl record if you plead guilty are you?
    • DX: I did not pursue Link after I got the CCJ amended to monthly payments. Pretty sure the CCJ does not mention reviews, I do have the CCJ somewhere, I will have to look it up in storage. It is as mentioned on the thread you referenced  in your post #28. The Barclays loan was taken out in September 2004 for 60 months! Current Balance remaining approx £2K. On checking back my past correspondence with Barclaycard about this loan, there was a history of them ignoring my letters and offers to pay, and I even had problems in obtaining their bank account details for them to accept my payments! I have received strange correspondence from them too, one referring to insurance which I did not have. They seem very disorganised! Barclaycard told me to pay "Masterloan" a while back and I now receive regular statements and arrears notices from "Personal Loans from Barclaycard" clearly marked Masterloan, they changed the account reference number! I have never requested a CCA on this account. I advised them of my change of address last September, but they are still sending, until today, statements etc. to my old address! I have received 2 letters from Barclaycard Loan today though, not opened them yet!!
    • Yes, a few months ago. They wrote back saying there was no CCA and the debt was unenforcable. I then started gtting bombarded with threatening emails from their 'litigations team' which have been sent to spam. I've now recieved the letter before claim with the PAP form enclosed, but still no CCA or even a letter from them to say the debt is deemed enforcable. Thank you.
    • That's a shame but not unexpected.  I'm not sure about your assumed  questions because I haven't been to court but I'm not sure about not accepting a criminal record. It could be a language thing but it isn't your choice unfortunately.  HB

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I got a letter from these debt collection agencies in an apparent debt from t-mobile? I have a default registered on my credit report about the 98 pounds balance, but the account has been closed since may 2008?

 

I got this letter and it says they have bought my debt from t-mobile in 2008 and as far as i can remember i have already paid some of this? I dont have a copy of the reciept or anyting cuz its been so long.

 

I have been told i need to contact them within 10 days or they will take me to court.

 

Luckily before ringing them i googled them and came across CAG (THANKFULLY)

 

I have read everyones problems with them on here and was planning on sending them Template letter N from the CCA.

 

Before doing that i thout i would ask on here so you experienced lot can help me out please.

A mobile phone contract would not be covered under a CCA request, so would serve no purpose sending one.

 

DO NOT under any curcumstances telephone Lowells, they will tell you anything to extort money from you, regardless of wether you owe it or not.

 

I would send them a 'Prove it' letter and wait and see what documentation they send back.

Sending letter 'N' won't do much good I'm afraid as Mobile phone contracts are not coverde by the CCA.

They have to prove that you owe the debt.

 

Otherwise, I'll send you a letter telling you that you owe me £500.

 

Remember that these companies have NO legal redress over you at all.

 

The postman has more powers than these parasites.

Hi all, just to update on this matter. Since sending them a 'Prove IT' letter i have recieved three letters from Lowlifes.

 

First letter stated that they would contact t-mobile to get the statements for my account.

 

2nd letter sed they are still trying to get the statements

 

and recieved a third letter today saying they are still waiting on the statements and my account is on hold.

 

Now this has been near enough 2 months, so my question was, is there a time limit as to how long they have to get me the statements? Its been more then a month for sure.

 

Was just wondering.

If the Leeds Losers ever produce statements then write to them asking for proof that a written contract exists between you and TMobile as well as asking for proof that the debt has been properly assigned to them in accordance with S136 of the Law of property Act 1925

Lowells are on a bit of a purge at the moment had a few letters regarding a statute barred debt (statue barred by 11 years). Also had a couple of calls to my parents address where I am for Christmas, I never answer them as there is always the long pause before anyone speaks which is a dead give away.

ok folks, recieved a letter from them about a month ago saying they have not managed to get any statements so they are closing the account which i thought was a success.

 

Just recieved a letter from them showing a statement which they recieved from t-mobile from december 2007 showing an outstanding amount. I have no knowledge of me not paying this. Im sure i have done. Wat can i do now? Should i call them or pay?

Ignore the muppets. They still havent sent anything proving you had a written contract with t-mobile

If you had to sign something then that is the paperwork that will be their proof. Anything else they send is irrelevant.

 

Did you get the contract online ( Ticking a box to agree) or did you have to sign something?

Al companies in the Lowlife group just pass a debt around their office and use a different trading name in an attempt to confuse.

They sent me a copy of a statement they had made up and said it was an agreement.

So beware of Lowell Portfolio 1 Lowell Financial & Red Debt collection also Mackenzie Hall are now part of Lowlife I am waiting to see if MH will be used on debts where Lowell have failed to collect.

They have just had to shell out for my court costs, after losing miserably re: a SD they served on me, also another CAGer a couple of weeks ago, more costs!

I wouldn't worry about what 'might' happen, besides, going to court is nothing to be worried about, this is where you want it to go, that way then they will have to show the DJ the evidence that you owe this money, and 9 times out of 10, you'll be able to rip them to shreds.

 

If your worried that they will take you to court, and they have mentioned legal action or court action in their letters then you can send them a CPR31.14 request for the evidence they will use in court to enforce a judgement, this is similar to a SAR but doesn't cost you anything, and they have to provide all the evidence they will rely on in court.
