Hey folks,

 

I have sent SAR to HSBC relating to my credit card account and got reply saying thank you for requesting details of bank charges :)

 

They also returned postal draft of 10 pounds.

 

My main aim is to remove default and late payments from credit file. What would be the quickest and surest way to raise dispute with all 3 credit agencies? At this stage I am pretty confident HSBC lost the paperwork.

Hiya Alex, you have two choices really, write back confirming the bank have not fully complied with your SAR and confirm they are in breach of the Data Protection Act until they send the rest of the information regarding your card or, send off a Consumer Credit Act section 78 letter asking for a true copy of your credit agreement.

 

Either way you can now asses the charges that have been applied to the card and request the return of these charges (see the credit card claim preliminary letter in the library) you need to keep in the section that confirms the charges added to your financial difficulty and were a direct cause of the defaults and therefore the defaults must be removed too.

having reviewed all you various threads on here, you never seem to complete anything?

 

generally you seem to be on a crusade to get various 'wrongful' markers etc removed from you CRA file.

 

typically, the only way to get these removed is to prove they were placed there in error in the first place, i doubt ALL of them were.

 

as for credit card markers, IF the marker is SOLELY the result of unfair charges AND the co refunds said charges, then the assoc markers should be removed as explained above.

 

please keep this thread updated, we dont mind helping, but leaving threads dead is frustrating to others trying to find the same info

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
