    • Hello CAG Team, I'm adding the contents of the claim to this thread, but wanted to open the thread with an urgent question: Do I have to supply a WS for a claim with a court date that states " at the hearing the court will consider allocation and, time permitting, give an early neutral evaluation of the case" ? letter is an N24 General Form of Judgement or Order, if so, then I've messed up again. Court date 25 May 2024 The letter from court does not state (like the other claims I have) that I must provide WS within 28 days.. BUT I have recently received a WS from Link for it! making me think I do need to!??
    • Massive issues from Scottish Power I wonder if someone could advise next steps. Tennant moved out I changed the electric into my name I was out the country at the time so I hadn't been to the flat. During sign up process they tried to hijack my gas supply as well which I made it clear I didn't want duel fuel from them but they still went ahead with it. Phoned them up again. a few days later telling them to make sure they stopped it but they said too late ? had to get my current supplier to cancel it. Paid £50 online to ensure there was money covering standing charges etc eventually got to the flat no power. Phoned Scottish Power 40 minutes to get through they state I have a pay as you go meter and that they had set me up on a credit account so they need to send an engineer out which they will pass my details onto. Phone called from engineer asking questions , found out the float is vacant so not an emergency so I have to speak to Scottish Power again. Spoke with the original person from Scottish Power who admitted a mistake (I had told her it was vacant) and now states that it will take 4 weeks to get an appointment but if I want to raise a complaint they will contact me in 48 hours and it will be looked at quicker. Raised a complaint , complaints emailed me within 24 hours to say it will take 7 days till he speaks with me. All I want is power in the property would I be better switching over to EON who supply the gas surely they could sort it out quicker? One thing is for sure I will never bother with Scottish Power ever again.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Right had letter off scabby this morning heres how it goes

thank you for your letter of 28 july 2006. I am sorry that you were not satisfied with the response that my colleague sent to you in march 2006 in relation to the charges on your account.(the letter basically said bog off charges are reasonable blah blah)

Firstly please accept my apologies for any inconvience that you have been caused in relation to this matter (blah blah)

 

I have carefully considered the points you have raised (thanks bank templates )in your letter and i must reiterate that the charges incurred on your account are valid and not unlawful,they are in line with the terms and conditions of your account.I am therefor unable to offer you a refund of all the charges on your account since 17 august 2003 totalling £2,397.00 as per your request.

 

I have however,arranged to refund your accont as a gesture of goodwill the charges on your account fron september 2005 to date totalling £680.(Why if there not in the wrong why they wouldnt do it in march didnt wanna know)This sum includes charges that are due to be added to your account for August 2006(there was only charges in August because there charges forced me to go overdrawn)

 

I accept that you did not set out to incur charges (your bloody right there no thanks to them)on your account.It is however your responsibility to monitor your account and ensure that there are suffient funds in your account at all times (blah blah what are theres!)

 

To prevent further charges you could ask for a******and it goes on about having an miracle overdraft thatll just make my problems a hundred times worst!!

 

Now what now?Do i write back and ask for actual berakdown of figures or just subtract it and carry on with schedule there really messing with my head!!

hiya got another problem now have gone through the list of charges on the bank statements and the amount on their letter is wrong its not the same as the amount i got it to its about £200 out make sure people check.I also phoned them and asked what amount had been refunded to our account she told me £625 but my calculations make it more like £810 what do i do know wait and see if they refund more or what!!oh what joy we have with the grabby!!

Oh by the way karnevil me and my very nice bruv worked out the estimated charges and i was only out by £30 so im going to leave it as it is ta for helping me though ill try and help suz with it

gladly suz i did phone them and asked to read out the charges from there screen so she did i think although her version and what was in the bank varied so ive asked for a posted statement to check it again.Also got two more letters from them this morning saying there dealing with my complaint and will be in touch within 4 weeks i wont be waiting that long however.By the way were you being ironic or wot!!By the way i added up the charges on the spread sheet a little difference in there figures and mine but will wait for statement to come i think!!xKia

so now i know what theyve done do i send another letter with the new amount on it or go to court action as i was onto the that bit before they paid the refunds into our account hoping to fob us off again ha!

had spot of good fortune with alliance and leicester either that or there better organised but there statements arrived within the forty days and all in correct order etc but the scabby oh dear what a shambles maybe they should change there secretary cause there much more efficient

right will bring you up to date have redrafted spreadsheet because have made complete mess of it and it was two hours well spent as id doubled alot of the entries so time well spent so now print ot out and write another letter to them know it slows things done but dont want them saying i did the spreadsheet wrong or asking where i got my amounts from so will do that tommorrow

oh dear what are abbey up to pt2 they sent me a second statement today for august 2006 but its only for one day and no charges on it crazy or what there losing the plot big style what next half a day statement

kia back again like the proverbial bad penny right whats been happening not alot the printer has died of spreadsheet overload but i think were back and running.Bad news on the benefits front on the wrong benefit unfortunatly so gotta wait till money allows to get court case but decieded to go withadvice on court forms to go and pick them up from court so maybe not as intimidating to little old me suz is off line for now due to move hope shes back with us all again soon xxKia

right quick update sent off there final letter from me now its court hoped id be the first to get all there money back without court wishful thinking eh!!by the way stupid question i know what does DLA mean karny your probably thinking how thick i am when you thought i was intelligent no such luck just a thicky like the rest of us so sorry for not answering your question cause i simply didnt know the answer its not i was being ignorant sorry!!KIa
