Ok, I complained to The Halifax.. They issued a final response straight away. I went to the Fianancial Ombudsman and they sided with The Halifax and were unable to up-hold my complaint and advised the Halifax have done nothing wrong as it was a policy change and felt I was not treated unfairly... Spoke to them this evening.

Barclaycard £792.28 Refunded (May 2010)

MBNA £277.00 Refunded (April 2010)

Not surprised at the FOS. They always seem to side with the banks - but at elast it cost HBOS £450 for you to get them involved. How about OFT?

 

I think there is merit in using the template at the beginning of this and once you hav epaid them around £100 more in new charges than the old interest rate raise a small claims action for the difference using the unfair terms argument. I don't know what will happen - but it would at least be fun!

Iam sorry this was of no help to you! They really have got people over a barrel-and before Christmas when customers will rely on they're OD!!

Iam not happy Ive had to do this-tried asking if they would freeze the OD so I could make regular repayments from my JSA-NO JOY!! Those fees could be contributions towards settleing the debt. Anyone have any advise on the hardship/JSA/low income front??

 

Have you tried CCCS or Citizen's Advice? They are both quite good at getting interest frozen and affordable repayments set up.

 

Also this one IS something FOS might help with under a hardship claim.

 

Try both at same time - costs you nothing.

£450! nice... I reduced my overdraft this morning by a further £50.00 today and will be a further £50.00 tomorrow once some funds clear. I was that angry with FOS I emailed the CEO of the FSA and called them powerless and a coward... Not like he will ever read it... Could I still send the Template letter even if my complaint has been knocked back?

I will try the OFT, will they do anything tho?? and should I send the template letter??

hiya all

 

ive got my own thread see post no 65

 

but what im doing is the same as others but ive also emailed my local councillors and ive had one councillor express a good interest whom im hoping to meet up with

 

so if nothing else try that angle too

 

but yes i too will be costing halifax a further 450.00 for fos to investigate just for the hell of it knowing perhaps it wont do any good but its good paper trail for my councillor to view;)

It's not a question as such, it's expressing my bewilderment yet again as how they can be allowed to unilaterally trap so many people and not have to give them a reasonable opt-out the way Cap1 did for example, and the fact that apparently no-one gives a flying f*** about the people caught in that trap.

Surely the fight back must be with the FOS? There is no way Halifax can make a profit if it costs them £450 for every complaint.

 

Is it really that simple? Complain to FSA just so they get a £450 penalty charge?

 

If it costs them that much, why are they not taking a softer position?

 

Cag must encourage the fightback through 100s of FOS complaints. I for one would be quite happy to be stuffed with a £2 a day fee for a short a while as I can arrange, knowing I have caused them £450 trouble in return. Multiply this by 2000 , 3000 etc caggers.

At home at the moment having been redundant late last year for the second time in 2009! :sad:

 

Today, I was listening to the Treasury Select Committee investigation into the bank bonuses (Don't even go there!)

 

John McFall the Chair of the Committee was questioning Daniels (CEO of Lloyds Banking Group (LBG)) on the bank's policy of social exclusion and the like. John McFall challenged Daniels on it's whole charging regime with regard to charging the poorest members of society the most for overdrafts. Daniels didn't have a clue and John McFall read out a couple of letters from Halifax customers on the new charging regime. John McFall then asked Daniels how he could justify something like a 1568% (or something equally obscene) for someone to have a £200 overdraft. Daniels denied any knowledge, thought it could not be right etc. Daniels has had to promise to come back and confirm details. A scolded school boy springs to mind!

 

If would have been funny, had it not been correct. John McFall was not impressed.

 

The committee also ridiculed him for not knowing the correct number of redundancies he has made, is it 6000, 12,000 or 15,000.

In Martin Lewis's MSE News of 22 Oct 2009 he stated HBOS would put a £10 "buffer" in place - so the £1 or £2 charges won't apply if you are under £10 overdrawn. I have just been charged £2 for being 15p overdrawn for 1 business day - and the HBOS help line knows nothing about the £10 buffer!

 

Does anyone have any info on this - preferably from HBOS themselves?

We have 2 accounts with them - my husband is having the £12.50 one as it gives you a few benefits, as I am sure you know. But I am using the Reward account which still pays the £5 pm. Do some number crunching and see which suits you best. I dont earn the £1000 pm for my account but I bounce money between the 2 accounts to make sure I hit the target and get the £5. Its very easy online if you havent registered for that yet. alot better than going to the branch. I am in no way saying these charges are great but at the mo making the best of a bad thing. Hope you find a new job soon - take care

This site is useless. You can easily waste hours reading unhelpful wafflings from people who clearly have no clue about how to help desperate people.

 

These Halifax charges have been in place since last December and not one person has added anything useful here. FOS are completely useless, so I wouldn't even bother writing off to them. Also, advising people to send off useless templates to banks who clearly do not give a **** about your opinions is just a waste of their time and adds to their worries.

 

While you all sit here blowing smoke up each other's ***** there are thousands of desperately poor people looking for help.

 

Thanks for nothing you wasters. Where are the legal advisors or MPs and people who know what they're talking about!?

 

And as for everyone else, there should be a clear rule for this site - if you don't have something helpful to say, don't say anything. Otherwise, the site managers could split the helpful comments from the whitterings. It would probably take 2 minutes to read things that now take 2 hours.

iddles10 people on this site come from all walks of life,and are here to address a wide range of issues.

Not everyone is able to answer questions that will resolve a members issues,but theres a great deal of users who have learned by reading and understanding the best ways to resolve or work to find the best ways of dealing.

MPs who know what they are talking about are very hard to find,ceratainly they are not likely to be found on here,and no one said they would.

This is a self help site,and maybe your expectations are a little to high.

If you take time to look around,you will see there are lots of informed users,and a few legally trained advisors,but they cant be everywhere at the same time.

As with every internet site-especially one with almost 250k members,there are always going to be differences of opinion.

You would do better to be making more constructive comments rather than the ones that you have posted,having something helpful to say should equally extend to yourself !

If you think this site sucks then post useful/helpful information here instead of being a jerk

 

Clearly there will be many people who are reticent about taking drastic action but there will be some who do

 

Obviously those that dont take action because they are fearful/ nervous/ anxious will continue to talk about the issues befoire some of them take action - this is not wrong!!

 

FYI I have changed my bank after nearly 20 years with Halifax - I moved to HSBC Premier account which has a much better deal, but you only qualify if you have quite a bit of asset or income. So it is not correct that we dont do anything

 

Other banks may well be more appropriate for those who are not lucky enough to have adequate savings to qualify, but I would urge everyone to move their accounts

 

Consumers of the world unite!!

 

ps my mother used to tell me that if you have nothing positive or constructive to say, then dont say anything - maybe some of us need to take that lesson
