    • Hi I received a Parking Charge letter to keeper on Monday 15/04/24, the 17th day after the alleged incident. My understanding is that this is outside the window for notifying. The issue date was 08/04/2024 which should have been in good time for it to have arrived within the notice period but in fact it actually arrived at lunchtime on the 15th. Do I have to prove when it arrived  (and if so how can I do that?) or is the onus on them to prove it was delivered in time? All I can find is that delivery is assumed to be on the second working day after issue which would have been Weds 10//04/24 but it was actually delivered 5 days later than that (thank you Royal Mail!). My husband was present when it arrived - is a family member witness considered sufficient proof? 1 Date of the infringement  arr 28/03/24 21:00, dep 29/03/24 01.27 2 Date on the NTK  08/04/2024 (Date of Issue) 3 Date received Monday 15/04/24 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012?  Yes 5 Is there any photographic evidence of the event? Yes 6 Have you appealed?     • lookinforinfo - many thanks for your reply. It would be very interesting to get the letter of discontinuance. The court receptionist said that the county court was in Gloucester 'today' so that makes me think that some days it is in Gloucester and some days its in Cheltenham, it was maybe changed by the courts and i was never informed, who knows if DCBL were or not. My costs were a gallon of petrol and £3.40 for parking. I certainly don't want to end up in court again that's for sure but never say never lol. Its utterly disgusting the way these crooks can legally treat motorists but that's the uk for you. I'm originally from Scotland so it's good that they are not enforceable there but they certainly still try to get money out of you. I have to admit i have lost count of the pcn's i have received in the last 2 yr and 4 months since coming to England for work, most of them stop bothering you on their own eventually, it was just this one that they took it all the way. Like i mentioned in my WS the the likes of Aldi and other companies can get them cancelled but Mcdonalds refused to help me despite me being a very good customer.   brassednecked - many thanks   honeybee - many thanks   nicky boy - many thanks

This is nothing about paying just for what I use - I currently prefer the averaged monthly payment - else i wouldn't be in credit month after month - which I am comfortable with - else I wold simply request a part refund - which I  would have done if they hadn't reduced my monthly dd after the complaint I raised (handled slowly and rather badly) highlighted the errors in their systems (one of which they do seem to have fixed) Are you not aware DD is always potentially variable? ah well, look it up - but my deal is a supposed to average the payments over a year, and i dont expect them to change payments (up or down) without my informed agreement ESPECIALLY when I'm in credit over winter.   You are happy with your smart meter - jolly for you I dont want one, dont have to have one  - so wont   I have a box that tells me my electricity usage - was free donkeys years ago and shows me everything I need to know just like a smart meter but doesnt need a smart meter,  and i can manually set my charges - so as a side effect - would show me if the charges from the supplier were mismatched. Doesn't tell me if the meters actually calibrated correctly - but neither does your smart meter. That all relies on a label and the competence of the testers - and the competence of any remote fiddling with the settings. You seem happy with that - thats fine. I'm not.    
    • Evening all,   So today, I was sent an updated offer that includes the £12.60 I spent on letters, but they have declined to add the interest at £7.40. They have stating 'We acknowledge your request to claim interest to date, however, this would be at the discretion of a trial judge if the claim did proceed to a trial hearing.' I think I am content with this outcome, and pushing this to a trial for a total interest of £15.30 throughout the claim does not make sense to me.   What are people's thoughts? I am sure our courts have better things to concentrate on?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

just a warning to all of you considering blemain finance as a loan company.

 

i made the huge mistake of using this company , reccommended to me by ocean finance. the company insist i take out a joint loan with my wife. i thought nothing of this -until i missed a payment. what blemain do is their small print states that they can ring or mail you upto 4 warnings per month at £35 . what they mean is 4 times per person even though its the same loan. This is a max of £280 charges per month, which when disputed, they state is reasonable as they have capped it to 4 per month. i has 2 letters and 2 calls on the same day.

 

i lost my job and asked them to defer the payments or part payments until i was back at work. they issued a summons to reposess my house in response.when i questioned it with them at monarch recoveries ( their in house debt collectors), they said they going to 'take my house'

 

the small print states that if you dont provide them with a copy of your house insurance by a deadline, they will charge you an inflated insurance to cover the house and charge it to your loan. i sent it but they claim they never received it . my house insurance is £230 per year. they charged me £634 and refuse to send a copy of the cover they state they are providing me with.

 

i asked them for a breakdown of charges so far on the account. they sent me a statement of repayments so far without the charges being listed. six requests so far and nothing forthcoming.

 

i have since got back on track and intend speaking to the fsa about them but blemain will not send me a list of charges , as i suspect they know it will be damning.

 

if you are with blemain already - send everything by recorded post as they will deny receiving it, and insist on a list of charges. good luck

Years ago we had a mortgage with a company who were terrible with their charges. If you were late paying charges piled on and a lot of people had their houses repossesed within 3 -6 months of first getting into trouble with payments. The charges just spiraled and it was very difficult to get back on top of things as the company did not care and had some very dodgy practices. Roger Cook exposed them on a documentary and they got closed down only to reinvent themselves as a different company. A lot of people suffered under this company.

10000 borrowed 6000 repaid yet i owe over 16000 because of missed payments grrrrrrrrrrrr

Blemain Finance are the worst company in the world to deal with they think themselves above the law i have a loan with them and missed 2 payments but i did call them and tell them that payments would be made as i had been off work, they very easily told me they were taking me to court for my house even though i had phoned them and made the aware of the situation, anyway upshot of it was they took me to court and reposs was suspended on the grounds that i paid something off the arreas each month to which i have to say had doubled in size since going to court where they got that amount from i will never know as they are very underhanded. i went to seek advice from the CAb because in between going to court and making the payments that the court had ordered they had somehow managed to obtain a eviction notice after the court date i was at my wits end they obviously did not listen to that judge when he made the order to get that notice i recieved the warrant of eviction 3 weeks before it was due to happen so again back to court i went, but they was forced to cancel it due to the fact i had not missed a payment the CAB were really helpful put me in touch with a solicitor who is dealing with this but alas she herself is up against them for they are still trying for a second time to get another repsoss on my house i have yet been served another notice of failing to make court order payments i have copies of all bank payments made and all are on time this has been going on over 2 years now and i see no light at the end of it as they are still messing around when it comes to getting anywhere with them, my solicitor has now instructed a barrister to look at this case as she feels what they have done is unenforceable she is hoping to get this sorted soon but like i said it has taken 2 years so far and every month i am in receipt of 2 letters from Blemain which ther is a chare of 35 pound to my account so it is all just building up and adding futher costs to myself so guys any help would be most welcome

hi all in all my loan was for 25,000 but now it has reached almost 32,000 pounds and climbing so far the letters are arriving at 2 a month have spoken to my solicitor and so far she has to get in touch with her barrister and then to cap it all on saturday i get a letter saying i have fallen behind with my court order ha ha never i have every single receipt the bank gave me but they have tried every trick in the book to get me to phone them, however as my solicitor is dealing with it she will be getting in contact with them i cannot wait to see if they get another eviction notice as last time they ended up looking daft in court when i had produced all relevant paperwork the judge made them pay my court costs so i will be keeping you informed how i get on and thank you for your query, satan

After five years of haveing a loan with blemain i asked for a ballance and was shocked when i relized the loan amount is the same also i was missold ppi with the loan but i cannot claim it back got as far as fos they said i could not do any thing .just resentl i was offered free solar pannels of british gas when british gas asked blemain for permission they said yes but wanted £250 pounds for the letter this company are modern day cowboys and i would not recomend them
