      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hmnn its gone well beyond a yoke.

 

We had the earlier tacs from Egg where they refused payments for a CCA by postal order......

Then their demands that requests were made with a sig.

 

Whatever became of the teleograms as well ?

Older Hillesden /DLC watchers will remember them well.

 

I think the 2008 CPUT regs saw that well and truly off.

Morning everyone,

 

Didn't have time to start a new thread on this one :eek:

 

Last Monday sent EGG a complaint regarding PPI on an old Egg loan, citing high pressure tele advisors & my employment status. Expected the usual fight.

 

Letter pops throught the door this morning AGREEING that I should not have been sold the PPI and a cheque for £1,850 will be sent out within 10 - 14 days.

 

Shocked and stunned (Barclayloan victory last week and now EGG - I'm on on roll, whose next :D )

Seriously though I got one of these silly cards a few months back and Im still waiting for a representative to call. This is just another ploy by the chicken pluckers to get you to ring their threat centre so they can peck away at you and ruffle your feathers

I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

That's good news delevered very quickly!!

 

Egg must have had their knuckles rapped because there seem to be a lot less rejections recently. I have 2 with the FOS (been there for 1 yr now), they made an offer on the one to the FOS but not the other. As the second loan was a refinancing the FOS apparently want Egg to make an offer on both so it has been referred to another Adjudicator.

Hi peeps, been a while since I came on here to seek advice and help and boy what a help you have all been so a big thanks to all...............however, out of the blue I have received two....yes two letters from these people, one undated and this being an annual statement of account, followed the next day by a dated letter saying pay x amount and we will write off the rest! Now tempting as that might sound I have no intentions of doing any such nonsense even if I did have the money to pay it! My query though is this...............Last time I came on here it was another DCA chasing outstanding monies Lowballers - Scotcall - I sent off the CCA letter and my postal order back in ..wait for it....April 09. One day after I sent my letter and PO they wrote back saying basically HERE IS YOUR LETTER AND PO BACK WE RETURNED THIS TO OUR CLIENT ON XX DATE (the date on their letter) Please contact them with this refXXXXX their address is......Yes..............DLC !

Advice on here was sit back and wait and that is what I done until now, when the two letters mentioned at the top arrived. My Question now is, What to I do now?? This debt I believe is now around 10yrs old, I cannot recall when I last paid anything though believe it is around 8 yrs ago and until last year I had heard nothing. I see you are telling peeps on here that once the CCA letter has gone out it is that company who should supply the stuff. The 'Annual' Statement of Account actually contains nothing except to say the date of original agreement (14yrs ago not ten as I thought) with a date of this year with a statement period of 11 months from 2008 to 2009 which is already four months old. It does not show any payments made, any other statements allegedly sent out etc etc, it just tells me how to pay followed by the 'we will write x off if you pay x' Phew, I hope I have not confused you too much by all the writing, but do I contact them using one of your letters or do I ignore them? Its now a legal requirement for them to send out an Annual Statement of Account so dont worry.

 

You can do three things

 

1. Ignore them and eventually they will give up

2. Send them the Statute Barred Letter

3. Report them for chasing a debt which is in dispute by virtue of failing to comply with your CCA request

Can you tell me what address you sent your claim to and did you charge the interest rate on the loan + 8% statuory interest?

It was sent to Customer Relations Manager, Riverside Park, Derby.

 

I didnt quote figures, just stated that ppi was added to the loan & that the tele advisor put pressure on me to have ppi to get approval for the loan knowing full well that I was self employed (I believe Egg were fined heavily for high pressure ppi sales over the phone).

 

Refund offered is more or less what i expected so have accepted it (need the money).

I dont know whether to trust the FOS anymore, they found in my favour & told EGG to refund PPI, I had to sign an acceptance form before the FOS would instruct EGG to refund.

 

This morning I received a cheque from EGG in full & final settlement.

 

My PPI claim was for £1,614 BEFORE ANY INTEREST - Egg refunded £746.21 + 8% £337.62.

 

Needless to say I'm very disappointed. :-x

 

So can you argue this on the basis that you have to sign the acceptance without knowing what you're accepting?

Got smoke comin' outa my ears at the moment, My calculations was for about £4k including interest.

 

I had this discussion with the FOS over another card reclaim, if I didnt sign the acceptance form the FOS wouldnt pass it to the creditor and would close my complaint, that one has not been settled yet and I now desperately want to withdraw that form and proceed to court. They tolsd me that the creditor 'should' advise the settlement breakdown for final acceptance before making the refund.

 

Feel I've been 'had' over this Egg one, working it out this morning I cant even arrive at the same figure as Egg no matter which way I work the figures.

Hello Beachy!

 

Needless to say I'm very disappointed.
Chin up, just regard it as a down payment!

 

Next step is to write to Egg, demanding the balance, or you will take them to Court, and you will add s69 8% County Courts Act 1984 interest, right from the outset until the Claim is settled.

 

I'd also investigate Restitution, and consider a larger Claim for that, at their Contractual Rates, and Compounded not Simple Interest!

 

You now have the advantage of a FOS decision in your favour, i.e. irrespective of the amount they have paid (so far), FOS agreed it was miss-sold.

 

You have a leg up for Court already, and Eggy will know this!

 

It's a PITA, but next step has to be Court...go through all the motions, keep a tab on your Bill of Costs in case you get a chance to hit them with costs (it can happen, depending on Track and if Track is even allocated by the time you win), and be prepared to take it all the way in case they do not back down.

 

Don't get mad, get even!
