    • They have defended the claim by saying that the job was of unsatisfactory standard and they had to call another carpenter to remedy. My husband has text messages about them losing the keys a second time and also an email. What do they hope to achieve??? Most importantly,  as far as I have seen online, now I need to wait for paperwork from the court, correct?
    • The Notice to Hirer does not comply with the protection of Freedoms Act 2012 Schedule  4 . This is before I ask if Europarks have sent you a copy of the PCN they sent to Arval along with a copy of the hire agreement et. if they haven't done that either you are totally in the clear and have nothing to worry about and nothing to pay. The PCN they have sent you is supposed to be paid by you according to the Act within 21 days. The chucklebuts have stated 28 days which is the time that motorists have to pay. Such a basic and simple thing . The Act came out in 2012 and still they cannot get it right which is very good news for you. Sadly there is no point in telling them- they won't accept it because they lose their chance to make any money out of you. they are hoping that by writing to you demanding money plus sending in their  unregulated debt collectors and sixth rate solicitors that you might be so frightened as to pay them money so that you can sleep at night. Don't be surprised if some of their letters are done in coloured crayons-that's the sort of  level of people you will be dealing with. Makes great bedding for the rabbits though. Euro tend not to be that litigious but while you can safely ignore the debt collectors just keep an eye out for a possible Letter of Claim. They are pretty rare but musn't be ignored. Let us know so that you can send a suitably snotty letter to them showing that you are not afraid of them and are happy to go to Court as you like winning.  
    • They did reply to my defence stating it would fail and enclosed copies of NOA, DN Term letter and account statements. All copies of T&C's that could be reconstructions and the IP address on there resolves to the town where MBNA offices are, not my location

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

well i am going to use those arguments in court!:)

 

Also as that thread pointed out banks are very reluctant to accept faxed copies of documents themselves so why should it be differennt for us!:)

Posted a complaint to EGG over mis selling ppi 2 days ago, this morning Postie brings a total rejection/final response letter containing a photocopy of a screen shot in 'real time' of my on line application whereby the ppi box is clearly ticked - 'therefore we will not uphold your complaint and this is our Final Response'.

 

48 hrs for a rejection - is this a record?

Beachy, that is fast :eek:. Can I ask when your agreement was taken out? what shows that the 'real time' screen shot relates to YOUR application? How do you know that the PPI was not preselected? (unless of course you remember ticking it?)

 

I have a claim against egg in court for PPI mis-selling and they have never produced a single screen shot of the application process, just Application Review (AR) pages, that they claim was captured at the time of the application.

 

Would you mind posting the screen shot(s) minus and private information?

Put them to strick proof of the quote by e_inspired IMO.

 

They must surely be able to show a blank form online or written instruction stating if you do not require PPI please untick the box. Either way I reckon the online tick in the box issue is extremely dodgy for them :eek:

 

They also cannot now show todays online details forms as they well have changed the format from the time your application was submitted.

 

Outright refusal gives you a straight to the FOS scenario.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

The exact same thing happened to me! A reply from EGG in 2 Days! Anty how im wanting some answers too as to what to do next. Please help if anyone can. I| ahve uploaded the pics which were taken with my phone.

Sorry haven't been able to post up docs., having a rough time with work issues & still browsing using my mobile.

 

My forms is exactly the same as Wilchy's, as you will notice their is no tick box or any reference to agreeing to have ppi accept for the box containg the words 'Unemployment sickness & Life'

 

I notice their statement 'manual alteration by EGG staff is not possible'

 

mind boggles!

 

Straight to FOS on this one I think, unless there is something I can fire back at EGG.

hi beachy my experience with egg exactly the same as yrs all standard i think, i have just won my case with the fos and am waiting on the cheque id say just go straight to the fos as i wasted a good few months playing letter ping pong with them and they didnt change their stance at all mine was an online application from 2003 and the ppi was pre selected same real time app as you though good luck :D

Thanks, you' ve boosted my spirits quite a bit, I have been thinking about going to the FOS, EGG seem pretty determined in their response, as you say why bother playing ping pong with them, the only difference to the screen shot posted by wilchy is that mine clearly states self employed.

 

so it'll be a letter to the FOS tomorrow :D

Wrote to EGG asking for them to reconsider their express delivery 'bog off) letter.

 

Yet again a 'bog off' letter within 48 hours of me posting my letter.

 

Complaint en route to FOS.

I still watch beachy.

 

PPI busy forum but keep at them and FOS will be slow but uphold most complaints and it is free so you can expect some cash back IMO.

 

RECONSIDER they will not do DELAY they will do. They know now PPI was a serious regulatory risk and they lost out so the aim of the game is to hang on to the monies they gained for as long as possible up to the wire hence all the delaying tactics.

 

IMO always write complaints to the ICO, FSA, FOS, OFT, BBA and compain like there is no tomorrow ;)

just had my cheque beachy as well as a little surprise of £200 compensation from egg 6 months from start to finish i only wish i had gone to the fos sooner :)

Been away from the forum for the past week or so due to a bad case of Flu, how I've missed the forum :(

 

Anyway, back to business - OH has two Egg cards (both in dispute) both cards date from 2003 - '04 CCA'd Egg back in May both contained the infamous 'Approved Limit' as opposed to the correct 'Credit Limit'.

 

Been in dispute with Egg ever since and stopped payments, not a dickie bird from Egg, not even a payment reminder, (account DN & TN prior to the CCA request).

 

Out of the blue last week OH received a letter from an outfit called Apex Credit Management Ltd stating that they have 'purchased the account and all rights, interest and claims' and that they are now data controller of OH personal data.

 

Apex state that they bought the debt in September, however, the enclosed Egg letter (not a genuine EGG letterhead) states that it was sold in November ?

 

Should OH request a CCA from Apex or just send the standard bog off Bemused Letter?
