Further particulars to appear in business letters, order forms and websites

 

7.—(1) Every company shall disclose the particulars set out in paragraph (2) on—

(a) its business letters;

(b) its order forms; and

© its websites.

(2) The particulars are—

(a) the part of the United Kingdom in which the company is registered;

(b) the company’s registered number;

© the address of the company’s registered office;

(d) in the case of a limited company exempt from the obligation to use the word “limited” as part of its registered name under section 30 of the Companies Act 1985(3) or article 40 of the Companies (Northern) Ireland Order 1986(4), the fact that it is a limited company;

(e) in the case of a community interest company which is not a public company, the fact that it is a limited company; and

(f) in the case of an investment company within the meaning of section 833 of the Act, the fact that it is such a company.

Central Ticketing letterheads give the address as B16 6AX

 

 

According to their ICO licence this is not their R/O.

As a search confirms thus;

Nahhh, I didn't buy the recorder Martin, the link provided

by BF doesn't offer the discount and in the absence of a

coupon code it's not a good deal compared to other retailers

on the internet.

 

I'm only going to buy one if I get the CAG discount, or CAG

gets a commission for the sale. Otherwise I can video any

outward calls on my computer.

 

Indeed, all other communication will have to be in writing

as I am actually heading somewhere with this now.. ;)

What I'm getting at Martin is, shouldn't their Registered Address

be on their Parking Charge Notices rather than the PO Box, as I'm

sure they will claim that they are indeed an official document?

 

 

Absolutely Dave-the regs appear to cover this point quite clearly...and the ticket is within itself a demand or notification for payment.

Dear Sirs,

 

I have received a, "paking ticket" from Central Ticketing, they have a

Birmingham address which is why I have written you. The, "parking ticket"

won't be difficult to deal with, as I am

aware that it is nothing more than a threatening invoice.

 

However, whilst completing some basic research it has been brought to my

attention that this so called parking ticket is indeed a notice, a bill, an

invoice, AND a demand for payment and

as such should give their registered address;

 

Requirement to display registered name at registered office and inspection place

3.—(1) A company shall display its registered name at—

(a)

its registered office; and

(b)

any inspection place.

6.—(1) Every company shall disclose its registered name on—

(a)

its business letters, notices and other official publications;

(e)

its bills of parcels, invoices and other demands for payment, receipts and letters of credit;

 

Please find attached a copy of the back and front of the,"parking ticket", it

is an exact digital copy and only my private details have been obscured,

which can be supplied on request.

 

This is therefore, a formal complaint against Central Ticketing for the

reason stated above. Should you need my permission to process my

personal data, you may treat this letter as a release and authority to do

so puruant to the Data Protection Act 1998.

I submitted a complaint to Companies House last month against another parking [EDIT] for exactly the same reason, here is the response I received back:

 

Thank you for your email with the copy of the PCN. We have received several complaints regarding these notices issued by different companies. Our Legal Department has advised us that PCNs are in fact invoices issued on behalf of the company and as such only need carry the name of the company. The PCN you have supplied correctly states the name of the company so there is no breach of company legislation.

Sorry if I misread your post Dave, was the complaint about not displaying the registered office address or the company name?

 

The section your refer to above only requires the company name displayed on invoices which these people appear to do.

Exactly. Remind Companies House of this. As their lawyers have declared them to be invoices why are they not acting when the legislation is clear and their own lawyers are clearly of the opinion that these are invoices. Add in any letters you get asking for payment as these are clearly "and other demands for payment".

I thought that was pretty straight forward, but lets just wait and

see what Birmingham Trading Standards come back with and leave

it at that for now. :)
