I have just received a county court summons from SCM Solicitors on behald of Lloyds in reference to my credit card. I have had the card since 2002 and never missed a payment until June 2008 when I became a full time carer for my wife and as such had to give up work. My wife has a recognised disability. We thought we were covered on everything but on over six products we have we have not been able to claim on any insurance policies.

I have paid whatever I can questioned the insurance just to be told the account is in default and I couldn't claim anyway. I requested a copy of my written signed agreement along with a clear breakdown of all the payments received. I received the agreement signed but no statement detailing all the credits paid and subsequent charges. Following on from this request I have now received a claim form requesting the amount to be paid in full the balance under the agreement is £16300 on a card that started out at £7k originally. I used the card for my business but due to reasons described above I closed the business to care for my wife. I have written letters prior to this sent recorded delivery offering a reduced payment and a partial settlement of £5k and all of them were ignored and went without response or reply.

I would appreciate some advice and support on the matter and how to respond. I still require a breakdown of all the insurance payments made to the account in the last 7 years which is still outstanding.

Can you please scan in both the agreement and the details on the Particulars of Claim . Minus any personal details.

 

When is the date of issue on the Claim form so we can keep on top of the timings for you.

 

Are you saying you had signed for PPI and this product was worthless to you ?

The agreement does not include any indicator for PPi but I am sure this was being charged so I put in a written request for further info and a breakdown which was never sent to me.

The CC issue date is the 13th. We have been Lloyds customers for 19 years with numerous products and they have been by far the worst to deal with.

Do you have a copy of the default notice they state was sent to you?

 

The first two look to be microfiche copies instead of photocopies of the originals, the t&c they will state are the back of the signature page. If this is so its enforceable, you will need to put doubt into that statement that they are joined.

The PPi has been worthless just estimated the costs and the insurance is in excess of £7k over the years it has has cost me since 2002.

 

If that was interest on PPI of a credit card then its interest is compounded so that figure will jump even more.

Ok, clearly PPI is not selected on this form, have they stated how it was added to the account?

 

You may wish to get a SAR in to Nationwide now demanding all data they hold on you including statements/comms log and most importantly all phone calls recorded... just so they cant state later down the line that you requested by phone.

Final post (apologies for so many)

 

You need to acknowledge this claim online and indicate if you wish to defend in full (would recommend) or admit claim, if you indicate you wish to defend you'll get a further 14 days (so 33 in total from date of claim form)

I tried to submit a defence online and the password claim no combo is incorrect and blocked me for two hours following three attempts.

I have also done as you have suggested and issued a letter requesting everything in full they or any other agency connected to the claim has on record regarding the account.

It clearly sounds that the PPI wasn't worth the paper it was written on !! If it is found that the PPI was indeed missold (i.e. it was useless - as it seems in your case) then it brings the whole agreement into question.....

 

You need to acknowledge receipt of the claim form within 14 days of the date on the claim, if you wish to defend then state this...BUT it may be too early to submit a defence. As you get a further 14+3 days in which to submit this...

....err if you paid off the default then to take you to court they would need to issue another default notice prior to terminating and beginning court proceedings.

 

EDIT: Ah scrub that just seen your end of last year comment, sorry jumped the gun there.

Ok Micky,

 

The Default notice you put up needs to be edited as it contains your card number, looks like they have followed the regs with the default although page 2 wasnt scanned/uploaded.

 

The application looks to be a microfiche copy with no tick in the PPI.

 

The court papers need to be edited as they show the claim number... some banks monitor these forums to harvest info. Not aware lloyds do but you never know.

 

Can I ask what the letter actually stated... under what authorities etc (CPR / Subject Access Request / Plain letter) etc as its very important that a certain route is followed to enable a robust defence to be entered (closer to the deadline, its too soon at present)

Micky, I have unapproved the link post 9 with the POC in. In the box that shows the solicitors address is there a telephone number under that and then your account number. You will need to edit that out.

 

Are you able to telephone Northampton tomorrow and ask if there is a problem with the log in reference. :)
