I have received a letter from mackenzie hall on behalf of Cabot Financial (Europe) Ltd, as I have an old debt that has obviously been taken over by Cabot. They want me to agree to pay £50 per month but I haven't got that much spare each month. They say if I don't they will arrange a DOORSET ASSESSMENT. I am paying £20 per month now as that is all I can afford. This debt is going back to 2005 when I moved abroad and forgot about it. What should I do?

Stop paying them.

Either ignore MH, or ask them to prove that you owe the sum ( CCA them where applicable ). It seems to be a rule of thumb that anything MH get hold of will be unenforceable.

Don't worry about a doorstep visit. It is very unlikely, and if it does happen you can just tell them to get lost.

Hi

I'm not 100% sure, the original creditor is Creation, which I think was a store card provider for Adams Childrens wear, and I think I may have taken out the card in late 1997 or early 1998.

The problem is that I moved abroad in late 2004 and stopped paying it - not purposefully but I think over time I forgot about it and because I wasn't receiving any letters regarding this debt from my previous address in the UK, I didn't make any payments to this account since I left.

This letter is a formal request pursuant to S.78 of the Consumer Credit Act 1974. I require you to provide me with a true copy of the credit agreement relating to the above account, together with any other documentation the Act requires you to provide.

I expect you to comply fully and properly with this request, within the statutory time limit. You are reminded that should you fail to comply with my request, the provisions of s.77(6) will apply.

Your attention is drawn to ss.5(2), 3(b),6 and 7 of the Consumer Protection from Unfair Trading Regulations 2008 (CPUTR).

I enclose a postal order in the sum of £1.00, which is the statutory fee. Note that these funds are not to be used for any other purpose.

If you are unable to comply fully and properly with this request, you should confirm this in writing at the earliest opportunity, and certainly within the statutory time limit for compliance, and return the fee.

We look forward to hearing from you.

Yours faithfully
