i'm new to the forum , i have had a letter explaining if i don't make a payment by 6 oct 09 wescot are going to see there solicitors ect , in a call i said i will set up a standing order for the 7 of each month , but the women who was arrogent on the phone said it was too late and i explained that council tax came first, so what happens next ??

it is for £740 i owe on a abbey overdraft i did spend the money so basically i have to pay it back, could i just go back to abbey and pay them, i also owe nat west cards £2,400 they did go to a debt collecter then i rang and said i would pay nat west but not a debt collector..

you need to send an sar to abbey in order to look at any charges on the account that you may be able to claim back in order to reduce the balance. this cost £10.00 do not answer the phone to dca's and if they do ring ignore them put the phone down. make sure everything you do from here on in is by letter only.

if dca comes back for cards send cca request this cost £1.00 p.o. never sign your letters print name only if you require any more info please post

i know it sounds daft but i did spend the money and i did not accrue anybank charges , the nat west credit card was frozen i have set up a standing order with them , last time with nat west i sent payment and got no cca response .

 

 

An overdraft is not covered by a CCA request, so they owe you £1 :p

Can you please clarify one thing here - are you saying you sent a CCA request to the NastyWest and they cashed the postal order?

 

If so, it doesn't matter whether they replied to you or not. You have clear evidence that they received the request, so you can send an "Account In Dispute" letter after 12+2 days and stop paying them.

yes they cashed the postal order about a year ago and since last june i have not heard anything until last month when i got a letter from a dca saying they have sold the debt back to nat west.

Keep the proof that they cashed the postal order as that is important. Until they comply with this request you are legally entitled to withhold payment.

how do i get abbey to get the debt back from westcot so i don't have anything to do with a dca ?

 

Abbey have sold it to Westcot & washed their hands of it effectively.

Westcot now legally own the debt.

However if they dont have the CCA, they are stuffed ;)
