Debt management and Debt self-help - Consumer Action Group click the above link and go read a good 20+ thread in the above forum and all your questions will be answered  if you have any outstanding  then please post with them later. everything is explain in numerous thread already here for you to understand at your own pace. there is not rush to do anything today or the next 10days bar simply stop paying. though as explained in my last post, whichever way you go not pay will equal a default which will trash your credit file for 6yrs so the quicker you stop the quicker they will vanish . dx  
    • The funds were taken by eBay, rather than Paypal.  I presume Paypal collects the funds from eBay, and so eBay then sting me for the money.   But either way, before this money was taken from my account, my eBay account balance showed as -£85.  Yes, my bank account has been debited by this amount. eBay say that they are completely removed from the chargeback process, because it is carried out by the buyer's financial institution.  So, conveniently, they cannot help, other than by refunding the chargeback fee of £14. 
    • Perfect, thanks for the detailed response. One question, do you know how long it takes for the breathing space to get applied? Say for example I have payments due in 4 days and I apply today how does that work? Also, sorry for sounding stupid but what do you mean by default once the breathing space is in place? I mean what does "Default" mean.  After the breathing space is over and I wanted more time, what would happen? I can and will afford the payments after a few months but I just need that breather to sort some stuff out, as I have said I have never missed a payment. Sorry for the many replies but after doing a quick search, correct me if I am wrong. If it then does go into default and it goes to a collection agency am I right in saying they will send many letters and they may consider a claim? and I should only response if an official MoneyClaim is made? Also, If it does go into default does this severely affect my credit score? or will this only be in the case if a CCJ is applied.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I think with the TRUST not finding the notes is not a big issue....as no one seems to be really bothered....there doesnt seem to be any public support for this sadly.

 

I will write again to the CEO of the Trust....I have written to the PCT...

 

Press etc is definitely one route I still need to engage....

Local press to start with, for sure - if you go to the website of the paper concerned, you should find a number or email for the features editor on there, or a link saying something along the lines of "got a story?". Email them with a summary of events, outling the the main points of concern and they'll get in touch. It may be a couple of weeks before they get you in, or it may be next day. Depends how quiet they are at the mo and how serious the back story is, although reading between the lines yours sounds pretty serious.

This is the second time a hospital has neglected my son, in novemebr 2005, he came out of a club and had called a taxi to go home some young girls were getting trouble off of some fella close by and asked my son can they have his taxi he let them and waited for another one, someone hit him over the head with a bottle he didnt see anyone, and passed out, when his taxis came the taxi wanted him to go to hospital but my son just wanted to get home he felt unwell, the next day he had a small cut on his head but had a massive headache and couldnt lift his head his jaw was aching and he felt ill, by the evening he was worse so his wife took him to hospital, he was put on a ward, to await some doctors, the doctors came examined him gave him a ct brain scan where they found a SUBARACHNOIDAL HAEMORRAGE, the told him he would have to be taken to london to a specialist hospital where surgeons would drill into his head and drain the blood off, 2 hours later they said he was fine sent him home with paraceptamol and that was it he was ill for along time he went back to his doctor who said just to rest, everything started to change for my son, his sense of smell went his taste went, he was tired, he was miserable snappying at every one, he had depression bad, but no one would help him, as the years went by his wife left him she couldnt put up with him anymore his moods were really bad he started drinking at night, then verbally abusing his wife and shouting she was scared of him and yet he was a gentle fella before , he took many overdoses and was in ITU many times suffering with fits, he drove 2 of his cars ioff the road smashed to pieces and he now has damaged legs, one of his cars landed on him and we almost lost him, he moved in with us back home we tried to sort the hospital out find out why they didnt do anything to help him but the hospital had nothing on my son said he was never here, 4 years alter we put in for DLA as he cant walk properly and is in pain, but they refused, we appealed they refused, but they sent us all the appeals letters and hey presto the piece of paper fell out and it showed his hospital number D.O.B. and the |CT scan which showed he had a subarachnoidal haemorage, he has now been diognosed with organic personality disorder, and a solicitor has now took his case on after 5 years because if you havent been diagnosed till 5 years later your claim starts from then the diognose of your complaint,,he stands to get a big payout but that has to last him as long as he is alive, now we have this other claim which really is a follow on from the head injury,, and where the hospital has neglected him again so do hospitals ever learn no they dont, nearly a year ago this month my son lay dieing with a DNR on him, he was flown to london put on ecmo for 36 days, today he is alive, when will these hospital stop harming opatients why dont they just answer what they did wrong instead i have to get all the evidence together against them, even though they have lost his nursing files, i have got the file from the hospital in london who saved his life, and photos of how he looked when he arrived by plane to london his lips were split he had a hematoma on his forehead, a bad urinary infection because the local hospital put the catheter in wrongly, a big hair stuck to his mouth so the london hospital took pics of him in this state,now im going to prove neglect, sorry this has been long but it is a long story and all because of neglect my sons health isnt good

its not about the money id like them to say sorry but that wont happen, i have given them the chance to tell me what they did to him but they wont say how the hematoma was on his head or how it was done he was in ITU in prone paralised how did he get this hematoma on his head why was he left in this condition why was he dieing, because one he caught swineflu in there hospital they failed to tell us that its full of neglect

Hi EIVAD5 hasnt the GP got any notes about your mums condition, what medication she was on and what about when she was an inpatient then released the hospital usually send a patinets release for to the GP telling them what they did meds ect, he must have some paperwork and now they are all computerised it cant be wiped off, just a thought,

the chief executive of the hospital will back his staff all the way, pals cant do anything , there isnt really anyone who will stand by you in what you say, we were told by the chief executive of ITU that they had neglected my son and there was a nurse in the room at the time and four of us, and now they denign all they said even though i wrote it all down i did a diary every day of what they did in ITU nurses names doctors names and photos, but they will always find a way around it, there is no justice to help us, i have some horrific photos we took in ITU, of my son, with split lips, cuts on his head bloody nose haematoma, and they say this can happen when a person is very sick , so it just happens?? if they wont own up to this then its the papers that i will go with photos of how they treated my son in ITU it wont look good for the hospital, and it will show people just what they can cover up im not ready to give up

hoping someone can help.

 

I have been trying to get justice in understanding what protection the public have over missing medical records. My mother (a GP herself) died unexpectedly after treatment about 18months ago. Soon after her death her medical records were asked for and I was informed by the hospital and consultant that they had gone missing.

In fact the hospital has lost the entire medical notes - thats over 4 weeks treatment she had just completed. Having written a formal NHS complaint, I received a pathetic note apologising and saying that they will continue to search. In my distress I contacted the Healthcare Ombudsman who after a 6 month wait, said they cannot help as the records are missing – which is clearly what I know already and hence need their help!

 

Please let me know what else I can do – its clear there has been a severe case of Maladminstration by the hispital in question, and yet there is NOTHING that can be done in order for this matter to be investigated further.

 

Any feedback / thoughts welcome!

thanks for your message - unfortunately the police will not help - as this is not seen as negligence even in the eyes of the law. According to them - nothing has been done wrong - the records are whats needed to prove the facts.

ring local papers up , they love any kind of NHS 'scandal' even if the actual truth is as mundane as the two files not being mated ... the local press never let the truth get in the way of a good slag off the NHS story.

 

i think ms Weatherwax has likely found the truth of the situation and that removing the tinfoil hat may gain you more clarity on the Subject, it's especially likely that a temporary or second notes file has been misfiled due to the complete absence of the notes from that inpatient stay.

 

James what law are you alleging the hospital has broken , because i cannot see that there is any evidence to suggest the notes have been stolen and medical negligence is a purely civil matter

Well after 2 years so many letters to our hospital i have finally found what i was looking for a large piec of paper with the hospital heading and signed by 2 nurses and the consultant who looked after my son i know know he had yes SWINEFLU, the consultant states that if my son had been given tamiflu he would have done better!!!!!! he also says "HE DIDNT THINK ABOUT SWINEFLU" yet at the time my son was admitted there was a pandemic but our hospital do not swab for swineflu, so no one noticed or bothered to see why 3 organs were failing 5 doctors had written in his notes " this man clearly needs to be in ITU, but till he was dieing he wasnt admitted to ITU, i have had to find this all out for my self by going through every piece of paper which are hundreds of pages but i found it all in the end, written by the consultants themselves and signed, i also found in the notes where the consultant DID say if he didnt improve with in hours then they would consider to take down his treatment this they denyed over and over again, we also have counnceling sheets that are missing they thought they had covered it all up, but 2 years later i have found it all, now its going to our solicitor at last, they will now be proved they lied, ican now sleep wonder if those doctors can sleep easily doubt it

our local paper wouldnt put it in our paper about the swineflu in our hospital no one wore gowns gloves or masks, we were allowed to sit in canteens with the rest of people carrying the virus on our clothes how bad is that, and also visiting a childrens ward at the same time because our dissabled grandaughter was in the ward at the same time and the consultants and nurses knew this, this is how swineflu spreads because hospitals do not isolate people with swineflu

thankyou HB, it has been hard work at times, but to get to the truth you have to keep digging till you get the truth they always stated he didnt have swineflu but in this complaints file where they cant hide anything they have actaully stated he would have been better if he had been given tamiflu, but at last i have it in writing and thats all i wanted to know was it SWINEFLU something they would never answer me with, because they never treated him for swineflu thats why 3 organs failed, but i got them in the end so never give upxx
