    • if yours says consumer too in red under the examination part (which you never signed) and  as that one does it uses the word contract, then its not a trader<>trader sale docket it's a invoice regarding sums owed for the car your purchased.   so good to go under your claim you had 14 days to return it under dsr as you'd not seen it, extended by 1 cal year as he didn't use nor refer nor provide your rights in a durable medium..   glad thats sorted....   to sort if it raiseable under the scottish SPC claim system, simply ring you local sheriff's court clerks office and ask.

I can send the actual invoice/deposit through pm if someone would like to see it.    I think trade flag on autotrader indicates the seller is a trader and not a private seller, I'm not sure they advertise trader to trader sales.   As per the website for a simple procedure in Scotland I think it references because it is a consumer issue it can be in my local area.    I'm not sure if anything other than what he told me, or became apparent on the advisories on the most recent mot is wrong with the car, however the badly done paint job definitely needs sorting, at probably more than the car cost...that has been confirmed by a panel beater/sprayer with over 40 years in the trade.   Hope this helps

    • I’m in desperate need of help
      I bought some clothes online in may through Evans and paid through PayPal
      returned them all seven days later
      I waited the 14days for my refund and no refund came
      I put in a dispute through PayPal but I didn’t get any emails to escalate the case - PayPal closed it. 
      evans said they couldn’t refund the money because PayPal have cancelled the refund because of the open dispute
      I contacted PayPal
      they said the dispute had been closed but Evans at no point had attempted a refund.
      fast forward to today
      I’ve got copies of numerous messages sent to and from twitter messages as it’s the only way I can contact them
      I’ve also contacted their customer service too
      all I get is PayPal have cancelled refund because dispute is still open.
      I have proved that the dispute is closed
      I have got an email saying that if Evans sent the refund they would accept it
      but up until the date I got the email they have not once attempted a refund .
       I have sent them a letter before court email
      I have even offered to have the full refund as a gift card just to get this sorted !
      I’m literally at the end of my tether and don’t know where to turn next !
      i suffer with mental health issues and this is affecting my health and I’d saved the money for a year to buy these clothes as I’m on a low income .

i have a welcome car loan

i have paid over half of it, and ive just lost my job and my house, ive missed two payments and ive told them the problems i am facing but there not having any.

they call non stop on my mobile telling me to make payment or they will pass the case to debt collections, i am close to breaking down i have no idea how to get this company to understand the problem i am facing please advice me??

they call around 8/9am and then again at 6/7pm and its the same person who cant even say my name right!

telling me to make payment give my card details etc... and ive explained over and over that i have no money left:(

Firstly when they phone tell them you want all corespondance in writing and simply put the phone down, these people are leaches the lowest of the low, you then need to get a CCA request off to them this costs a pound and there are templates on this site for this request, it is also worth sending an SAR request but this costs £10 but if you dont have the money for that at the moment the CCA request will do for starters and help keep them at bay for a bit, but do not talk to them on the phone and if neccessary unplug your phone just let your friends and relatives know why you have turned it off, and above all relax dont worry yourself there are plenty of people on here to help you sort these idiots out. I will try to get someone with more knowledge to check your post and try to help you further.

that is giving the car back and saying goodby to welcome


if you want to keep the car, we will move up a gear

ive heard if you have paid over half of the loan and you stopped paying

welcome can not do anything as their "contract" have alot of loopholes e.g. they cant take the car back etc..

if you have paid more than a third, welcome cant repo the vehicle with out a court order


had welcome in court a few times on that one

cost them a lot of cash

can welcome put a default or CCJ against me if i dont make payments?

and if they have already put a defualt of CCJ against me can they still carry on with the calls?
