thanks for the extra info on how they do the overcash "thingey" they didnt explain that when i was on the phone yesterday, but its ok NEW ACCT up and running, have arranged with work to have this mths salary paid into new acct and half way through cancelling DD just got couple more to do, then will pay ALL bills by cash (most companies have been really good about it) & they cant believe how much ive got to pay in charges this mth(£260) before i can pay bills off. Powergen have been great, and had long conversation with girl there who said she had same experience...wonder if she recorded that one !

so to answer your question, yes, id like to claim from MBNA aswell as Abbey but not sure if my brain can cope with all that yet,:confused: im still getting used to this lot and the abbey, also in "disscusions" with CSA ....

 

Hi Sandra. I've come over here from the MBNA forum because I think we had hijacked Genesco's thread! I agree, you do have a lot going on at the moment but right now you are just sitting waiting for the Abbey to send you the info on charges you need before making your next move. Sometimes it takes ages for a DPA request to be answered ..... they have 40 days to comply.

 

So ..... I'm trying to encourage you to make a start on requesting your charges info from MBNA. That's all you need to do for now, just ask for the information. Perhaps the same letter as you sent to Abbey will do (but try and remember to change the address, some people haven't!) Once you've got your copy statements, or whatever they supply, you don't need to send them a repayment request until you are ready.

Well done, most bills can be paid on line and negates the need for DD's, this will help in stopping further charges for unpaid DD's. Only trouble is you have to remeber to go on line to pay them, but does give you a bit of leaway with regards payment deadlines.

Got phone call tonite at 20.55 from abbey

asking all about my acct and how overdrawn it was, i explained that it was because of charges and that if they refunded the charges it wouldnt be overdrawn. Lady said did i know that there were no credits going into acct(REALLY??..) i said that i have moved to another bank as if i didnt then all my wages would eventually get taked in charges she then asked what i was going to do about OD and i said that i would pay it off with a min amount, she said that abbey were offering me a min amount to pay off (which was 3 x s what i offered ) i told her that it was in dispute and she wanted to know how far i had got and what letters id received from abbey, when i told here id got fob off letter and complaints letter and they had approx 20 days left, she then blerted out "oh thats what i wanted to know" (but why didnt she just ask me outright) and said that i must use the complaints prcedure to get anywhere as thats the ONLY WAY id get anywhere, once she had reinstated that a few times she was quite happy to tell me that she'd put my acct "on hold" untill the end of the month then i would be contacted again to discuss any further developements, O and when i asked for her id log in no she said she had been advised not to give it out but gave me her name instead... has anyone else had this happen to them or am i the first of anew tactic by abbey if so id like some advice on how to handle it if it happens again ??

thanks karn for that bit of advice, sending off my request for repayment of charges letter. iwonder why she woulnt give me her log in id tho as i thought i heard that if you ask them they should give it to you ?. What happens after ive sent this letter off ?

Just as thought, you are keeping notes of the phone calls, the content times and everything arnt you?

 

It might not hurt to write to them and cofnrim the conversation with any key points.

 

Call me suspicious but if your account doesnt turn out to be on hold you may end up with more charges and interest.

 

If you have written to them to confrim this then they will have less chance of muddying the waters when and if it turns out to be a problem.

they were absolute swines with us over our overdraft a few years ago they decieded to just withdraw our overdraft over night and said were taking back our £750 just like thaty and when i said could we pay it back over a period of time they grudingly agreed if only i knew then what i know now ggrrr!!!we should have switched then i suppose but we stupidly stayed with them.Not only that they put a bad credit mark against us just for that theyd make a saint swear!!

Same Question ....Different Subject

How long does it take to cancell D/D or S/O as i cancelled mine in August and they are still charging me for them in september, even tho they agreeded twice that they would be cancelled when i rang ?? does anyone know how they can still charge me ? :confused:

Well it should be instant.

 

Hopefully you have a record of when you called and cancelled.

 

Hindsight is a wonderful thing and if i was closing my accounts i would have cancelled them on the phone and then confirmed it in writing.

 

I would write to them setting out when you cancelled and confirming your position. I would also set out that you will refuse to pay any charges arising of their mistake.

im ringing them tomarrow am . will remind them of date i cancelled and when i transferred D/D to different bank and will also put it in writting too..... I mean 13 x £35 is a bit stupid or am i being picky ...lol

Hi all,

has anyone got any advice on ow im to handle abbey now, got letter yesterday saying that they hadent heard from me and that my bal on my acct is well over my limit and that i have to pay enough money into my acct to clear tha overdrawn bal and make sure this covers interest and charges still due on acct. If i dont them action will be taken to recover the balance and they will register a default with C R A ,i dont understand as they rang me in sept and said they would ring back at end of month to discuss what is happening with acct.. can anyone help ?

Write back to the person that has sent you the letter and explain that the account is in dispute. If the amount you are claiming is more than the overdraft etc then you do not have a problem.

 

There is a letter in the library that you can send them which refers to the Data Protection Act and will hopefully stop them entering any default notice against you.

 

When I sent them those letters the overdraft was removed compeltely from the account and they stopped charging anymore interest as well.

sorry i dont quite understand what you mean- my O/D limit is £1400 but with the 13 charges they added this month and the ones they added last month its taken the bal up to nearly £2000. Ive already told them the acct is in dispute when the lady rang me in sep. Surly if all "notes" on acct are put on my records then my conversation should show up when they look at my file ? am i being stupid ..dont you keep all contact records ie letters & calls in one place so they are easily to hand ? im beginging to get worried will they take me to court first :confused:

If they do take you to court then you have a valid defence for getting it thrown out in that you have already started dispute proceedings against what they say you owe them. Same if they pass it onto a collection company. A bailiff will leave you alone if he knows the amount is in dispute.

 

Make sure that you say in the letter that any charges applied since your first letter could be subject to a further claim as well.

 

And stop using the account, they will stop you using it soon anyway. If you have a bad credit history, try a Natwest Step account for a new account. The only downside is that you wont get a cheque book. Get everything transferred to that account and start afresh.

Dessie just tried ringing abbey but comps are down and thry say they cant do anthing , i will have to ring back but can i sent the template letter from bankfodder re: Persuite of ..... even though they may not have actually started a default on me .

If they have sent you a letter saying that they will default you then send them the DPA letter now.

 

If not I would hold off until they do and instead just send a letter to Debt Management (or wherever you are dealing with ref your overdraft) and make it perfectly clear it is in dispute. I would always put it in writing and send it recorded so that they cannot deny they have received it, or that they ahev spoken to you.

Can anyone suggest what i can do now, ive been on the phone to the debt management team and explained that the account is in dispute but she basically said that it doesn't matter ive got to make arrangements to pay the O/D off or they will pass it on a debt collection agency, im not saying im not going to pay but its just that i cant pay nearly £2000 off in one go. I told her that i was waiting to hear from the complaints dept and she told me to ring her back and let her know what they said and then make arrangements to pay - im really scared now i cant afford to pay it off in one go
