Hello All,

I hope someone can help me. Last Thursday i came home from work to find a letter had been hand posted through my door by the company Marston Group. It was entitled removal notice. Saying i owe them £525.07!! It says despite previous visits(they have never visited before!) and notices (never had a letter from them!) that my costs are going up and to contact them.

This was for 2 parking tickets, one that i got and one that my son got in my car. My son has appealed to the council about the one he got and so did I, he said hes not heard anything from the council and neither have i.

The first thing i did was go on the Marston website and pay the fine of £126.57 for my parking ticket. I then rang the bailiff a Mr Reid on the mobile number he had left me and told him I have paid and that there is no reason to re-attend my property. I told him my car was stolen 2 months agoso he cant recover it and that he could check on DVLA and that I knew my rights and that he will not be getting into my house. He said that i owed a further £240 in fees to Marston of which £175 was for attendence to removal fee. Also £35 for the first visit fee. If i paid in full there and then they would put the other parking ticket(my sons) on hold for 7 days.

I said to him that he cant charge me for the attendence to removal fee unless hes been in my house and knows if there is anything to remove and surley that would be charged on the second or 3rd visit?? He said he can charge it on the first visit.

Also Ive never had the first letter, this is the first time ive EVER had anything from this Company.

The next morning he text me and has given me untill tuesday to pay the balance to him or he will come back and charge me £44 for a second visit.

So only 2 working days to get this sorted!!

 

Yesterday i send a letter by special delivery to marston group head office saying i thought the ATR FEE was unfair and included a subject access request letter with a cheque for £10, i also enclosed a copy of a court judgement made against them in sept 2008. Judge Avent seems to be saying that on the first visit they should allow time to pay (which i did) before coming back to remove my goods. So There for charging me £175 whould be classed as excessive?? They shouldnt be removing goods on first visit??

I am on working family tax credits with 3 kids so this to me is a huge amount of money.

 

I have looked on the ministry of justice list of bailiffs and i cant find a mr reid, marstons are there but hes not on the list for them and there are only 2 Mr Reids and they dont work for Marston.

I have text Mr Reid this morning asking him which court and date he got his certificate etc, no reply as yet!

 

What I need to know is this, Is there anything else I should do before they come knocking on my door on Tuesday and put my bill up even more.

 

I would be so gratefull for any advise, I feel like im sitting on a time bomb at the moment

I have just looked at the two accounts on marstons online payment option and its showing i owe £363.16 for my parking ticket and £161.91 for my sons parking ticket.

Ive alreadys paid £126.57!!

When i looked on thursday night the account that is now £363.16 was showing as £126.57 which i paid!!

Im going to go to CAB in the moring but I would really love someones advise on the amount of fees im being charged, £240 inc VAT for the first visit on a debt that is only £126??

That cant be legal can it??

Thankyou! I think ive done all the correct things so far, statutory Delcleration was emailed today. We shall see if my baillif turns up tomorrow as promised!

You could get a friend to film the bailiff when he arrives it will be really entertaining, I am serious with my suggestion, I bet he suddenly becomes mute.

To be honest im to embarassed to tell my friends, i feel intimidated and quite worried at this moment in time:-|

But its a dam good idea!

Im going to be on edge all day tomorrow.

All i wanted to do was to talk to someone reasonable, i mean £525 is not reasonable with no warning!

 

But I am willing to go all the way with this, Marston Group is NOT getting another penny from me.

 

This is how I got my parking ticket, I work as a home carer and was attending to an 89yr old man with one leg, he was relying on me to get him breakfast/personal care. The place where he lived was having building work done and the small car park was full. I parked over the road in an disused bus layby, i was there for 20 mins. I felt my old man was worth the risk.

The council obviously did not think that was a good enough reason!!

 

This country is going to the dogs!:(

I've been on edge for three weeks tomorrow when the first visit and threat appeared and the whole of my world turned pearshaped, and the only reasonable person so far I've found is my MP (and those that have been in the same/similar situations as me on here or the like).

 

I'm lucky in as much my kids are my life, I don't socialise so friends I have are miles away and more acquaintances now, my family is the same and thus having noone to ask, its meant I've had to fight back cos I cannot afford the charges nor hassle of a bailiff. I run a gauntlet everyday I go out of the house to work, I'm scared and have to ring my son to make sure he's got out of the house ok on a morning and on his return before tea from school. My 5 year old is "fed up" of hiding in the house, but if I let him play out well, I can't leave the door open for him as I would have and I do not want a scene outside where my neighbours can hear (although one of the few I have must have seen something :/ )

 

Out of curiousity, have you been to the layby and checked for signage? I know nothing of parking tickets having never had one, but I'd be inclined to ensure I knew for definate there isn't any warning up there and if it is that its visable (take a camera). That way when you get out of this, you could maybes fight for the clarification of others, who knows it could be another home carer that gets caught in the same cycle as yourself.

 

Chin up you'll get there in the end (as I hope I do).

If you have a out of time stat dec make sure you have the proof when/if they come I left mine with solicitor and they didn't beleive I had one and terrorised me for 2 hour's until my daughter gave them her mortgage payment .. Ok this was refunded but 3 weeks ater my dd's payment was late nad she was charged by mortgage company..

Yes ive got a copy of it waiting by the front door as I type. If he comes to my door hes getting it shoved in his face because ive already texted him to say ive done one, hes ignoring my texts now, since i asked for his certificate number and issuing court. The court has a copy, Marston head office have a copy and he has his very own copy waiting for him ;)

 

Binded I know how you feel and im so glad I found this forum with people like you to give me support. If we all stick together im sure we can kick some serious ass!:D

Thanks, i think I will give them a ring tomorrow, ive spent so much time over the last 4 days finding out things and searching websites, running to the post office etc etc. That phone call was one i missed, ill do it in the morning and let you know.

The way i feel at the moment i fully intend to make sure Marston Group/bailiff regret ever tried tried to pull a fast one on me :D

Oh i dont know, not sure if i can film him without his permission??

Also he might see my camcorder and try to remove it!haha!

I could use my phone i guess? It will record his voice even though the picture might be abit all over the place, do you think i should?

Same here, I am pee'd off for the inconvenience they have caused me and the fact that my car is clamped and unusable, especially seeing that I am a lazy barsteward.

 

Lets double team them, if you have a record feature on your mobile or you have a video camera, secretly film him, do not open the door, just talk through the letterbox.

 

In all honesty, I dont think he will even turn up.

hide the camcorder expect its OK to film him, the bailiff might quote laws about filming its a pity he gets confused about what he can do legally.

Yes I think we should definatly team up against them, ive hidden my car and ill be using my partners for work but your right its very inconvenient but ill do whatever i need to.

Im just waiting on a reply from head office now, then ill be getting onto my council etc

But i do think that court case is going to be very usefull to use against them, its just a case of getting my head round the right way to procced.
