Robinson Way/Next judgement set aside & CCJ removed!!!

So I successfully got the judgement set aside based solely on my witness statement (big thank you to all the members who helped, including members of the site team) as Robinson Way were big chickens and didn't bother to turn up!

 

So a little while later I received my copies of the judgement and time/date of the next hearing (small claims). The notice also stated that the claimant (Robinson Way) had to pay the £75 hearing fee by 10th September.

 

I received a letter today from the Court stating as follows

 

Upon the Courts own motion. The Court has made this order of it's own initiative without a hearing. If you object to the order, you must make an application to have it set aside, varied or stayed within 7 days of receiving it.

 

IT IS ORDERED THAT

 

Unless the Claimant do by 4.00pm on 21 September pay the hearing fee in the sum of £75, then the claim shall be struck out and the hearing listed on the 10 November 2009 shall be vacated.

 

Soooo, they've obviously given up on the claim and are now just wasting time, but what I'd like to know is can I know claim for costs against them. I'm quite annoyed that I'm £75 out of pocket because of their ridiculous claim not to mention the amount I've spent on special and recorded delivery and the vast amount of my life sorting this out took up!

Yes, you should be able to put a claim for costs against them. If you speak to the court they should be able to help with the right form(s).

 

I'd wait until the 23rd to contact the court and see what has happened with this.

It was quite funny at the first hearing, it was a lovely lady Judge who got quite cross that they hadn't turned up
