Hello, I just wanted to say how helpful this site has been.

But, I have a minor issue.

Here goes.

I owe Natwest some money and before I could go to them and work out a repayment plan, they referred me to a debt collection agency (Triton) so the first thing I did was request the credit agreement between the 2 companies using the cca. I got a template of the letter from here.

After a while, I got a letter but from another company. This time Apex and I send them the same thing. They replied back saying I have to request the agreement from the principle company with whom the agreement was reached which is RBS?...I got confused because I do not have anything links with RBS. So I was wondering if someone could explain what that means?

Second, I also owe Orange some money, but not much at all and like with Natwest before I could pay them back they referred me to an agency, I followed the same procedures and they replied with a notice of intended litigation saying that if I do not pay within a certain time they will take legal action against me and also stated that I must pay them back almost immediately to prevent this. It is almost like they ignored me?

Can anyone give an insight into this matter..

Much appreciated :)

Hi jakemittle and welcome to CAG, in my experience the CCA is sent to the company who are chasing the debt and it is there responsibility to contact the original lender, however that is probably where the debt has been sold, in your case perhaps the DCAs are collecting on behalf of the lender and that you do need to send CCA request fo the original lender. In the case of RBS are you saying that you do not recall ever having a credit card or loan with them ?.

Well, I do not have an account with RBS. Only with Natwest?

If I need to send the CCA request to the original lender, I would have to send it to Natwest, of course. This is why I dont know where RBS fits into this situation?

In that case i would send the CCA request to Natwest.

Done.

How about with Orange?...How do I resolve that? Im sure the letter is a scare-tactic. But should I give them a couple more days or do I reply for a second time requesting a CCA? Or, do I just send it to Orange?

Oh and thanks for the welcome and for replying :D

Hi, jakemittle.

All sounds a bit confusing.

If you do not know the debt Apex refer to send them the 'Prove it' letter.

Regarding the Orange debt, the CCA does not cover mobile phone contracts.....

What was the Natwest debt ?

Regards.

Scott.

You say the amount owing to Orange is a small amount, and yes they are by way of a standard letter scaremongering, contact them by letter explaining that you can not afford to pay in one lump sum and make a repayment offer.

Well, I only have a debt with Natwest and Orange. No other, and like I said before I do not have any connection with RBS whatsoever. So this is why I am slightly confused. I will send a letter to Natwest asking them whats going on. In the mean-time do I just send apex the "prove it" letter?

The Natwest debt is £1,007

You say the amount owing to Orange is a small amount, and yes they are by way of a standard letter scaremongering, contact them by letter explaining that you can not afford to pay in one lump sum and make a repayment offer.

Right, but who do I send the letter to?..Orange or this debt agency?

And I owe them £277 which I can pay in full next month..but they are demanding it now :S...I am able to send a letter, but I dont know who to..

An update: Apex have now referred me to a solicitors asking for payment within 7 days or reason for non-payment despite the fact that they couldn't provide me with a CCA and instead referred me to RBS (who I have no connection to)

So this situation is making me even more confused..

Any insight on what I can do?

Thanks, so concerning Apex, itself, I plan to write a letter explaining where RBS comes in.

I plan on going to Natwest and speaking to them about this.

Is this the best course of action to take?
