    • In August 2018, I took out a 2 year contract with Virgin-pay monthly with handset included and payment by DD.   Everything went fine until February 2020 when a new second DD appeared for £6 with a number that I did not recognize-as it was clearly a mistake, Virgin refunded the £6, I cancelled the DD.   In March 2020 the DD amount had been added onto my main account as a second line with handset. There were now also details of a loan in the amount of £204 for purchase of the handset. I asked for details of this handset-what type it was, where it had been sold, any evidence that I had purchased it, any documents with my signature on. Virgin's reply was that 'I had bought it at my local store'(they couldn't specify which one) and that the fact I had a handset(I have not received anything) was proof that I had signed to this.   In April I put in a SAR request for any documents showing that I was responsible for this. It took until June for a reply(I was generous with them because of the coronavirus) when files were sent, but there was no password included to actually access the files.  Repeated requests for it got nowhere and in August the contract terminated and I moved to 3. However, Virgin still had me registered as a customer on a second line and are attempting to take money out via DD which is now showing as a failed payment. They also have a default on my credit report for the £204.   I repeatedly requested the password but this was not supplied, Virgin stating that they had fulfilled the SAR by sending the files, whether or not they could actually be accessed.    Finally on 29/9 I was promised the password would be sent to me by text message within 3-5 working days. When that didn't arrive, I was told once again that they had fulfilled the SAR and that if I kept asking for the password, the SAR would be rejected as 'repetitive demands'. Then I was told they would supply the password, but it would take up to 30 days.    Today I have been told that my SAR has been rejected(no reason given) and that they only have to supply data from the last 3 months.    I am desperate to get this removed from my credit file, Virgin have provided no evidence, refusing SAR requests(sent by email and mail) and are now in breach of GDPR for failing to provide the data in a timely manner.   Any help on what my next step is to proceed will  be muchly appreciated!

    • Send the SAR again registered post they have to reply. If they don't a Solicitor's letter will be the quickest way to remedy that. Glad you got the apology letter, keep safe with your Swift paperwork. A Solicitor will be able to point you in the right direction during this process of how best you can tackle Swift.     • hi.  i think they will be able to say manifest error that the markets stipulated some interest payment.  but the amount depends on central banks / libor rate ect and the amount of currency held and the length of time held. but they have deducted far too much so i am just wandering what sort of breaches i could write in the poc   thank you

    • I came across this discussion recently and just wanted to give my experience of A Shade Greener that may help others regarding their boiler finance agreement.
       
      We had a 10yr  finance contract for a boiler fitted July 2015.
       
      After a summer of discontent with ASG I discovered that if you have paid HALF the agreement or more you can legally return the boiler to them at no cost to yourself. I've just returned mine the feeling is liberating.
       
      It all started mid summer during lockdown when they refused to service our boiler because we didn't have a loft ladder or flooring installed despite the fact AS installed the boiler. and had previosuly serviced it without issue for 4yrs. After consulting with an independent installer I was informed that if this was the case then ASG had breached building regulations,  this was duly reported to Gas Safe to investigate and even then ASG refused to accept blame and repeatedly said it was my problem. Anyway Gas Safe found them in breach of building regs and a compromise was reached.
       
      A month later and ASG attended to service our boiler but in the process left the boiler unusuable as it kept losing pressure not to mention they had damaged the filling loop in the process which they said was my responsibilty not theres and would charge me to repair, so generous of them! Soon after reporting the fault I got a letter stating it was time we arranged a powerflush on our heating system which they make you do after 5 years even though there's nothing in the contract that states this. Coincidence?
       
      After a few heated exchanges with ASG (pardon the pun) I decided to pull the plug and cancel our agreement.
       
      The boiler was removed and replaced by a reputable installer,  and the old boiler was returned to ASG thus ending our contract with them. What's mad is I saved in excess of £1000 in the long run and got a new boiler with a brand new 12yr warranty. 
       
      You only have to look at TrustPilot to get an idea of what this company is like.

    • Dazza a few months ago I discovered a good friend of mine who had ten debts with cards and catalogues which he was slavishly paying off at detriment to his own family quality of life, and I mean hardship, not just absence of second holidays or flat screen TV's.
       
      I wrote to all his creditors asking for supporting documents and not one could provide any material that would allow them to enforce the debt.
       
      As a result he stopped paying and they have been unable to do anything, one even admitted it was unenforceable.
       
      If circumstances have got to the point where you are finding it unmanageable you must ask yourself why you feel the need to pay.  I guarantee you that these companies have built bad debt into their business model and no one over there is losing any sleep over your debt to them!  They will see you as a victim and cash cow and they will be reluctant to discuss final offers, only ways to keep you paying with threats of court action or seizing your assets if you have any.
       
      They are not your friends and you owe them no loyalty or moral duty, that must remain only for yourself and your family.
       
      If it was me I would send them all a CCA request.   I would bet that not one will provide the correct response and you can quite legally stop paying them until such time as they do provide a response.   Even when they do you should check back here as they mostly send dodgy photo copies or generic rubbish that has no connection with your supposed debt.
       
      The money you are paying them should, as far as you are able, be put to a savings account for yourself and as a means of paying of one of these fleecers should they ever manage to get to to the point of a successful court judgement.  After six years they will not be able to start court action and that money will then become yours.
       
      They will of course pursue you for the funds and pass your file around various departments of their business and out to third parties.
       
      Your response is that you should treat it as a hobby.  I have numerous files of correspondence each faithfully organised showing the various letters from different DCA;s , solicitors etc with a mix of threats, inducements and offers.   It is like my stamp collection and I show it to anyone who is interested!

Hi All

 

First things first, I have donated to this amazing site which I have been viewing for some time now, keep up the good work,

 

Here goes for my first posting.

 

I will try and keep this as short as possible

 

June: CCA request sent c/w £1 PO, unsigned and recorded delivery

 

June: Letter received from Cap1 requesting I pay £1 "I'm confused :shock:"

 

July: Account In Dispute letter sent explaining thatmy £1 PO was enclosed

 

July: Letter received explaining that they have no record of payment received although they failed to mentioned this in their 1st letter

 

Aug: Sent 2nd Account In Dispute letter explaining their incompetence over my enclosed fee and that they never mentioned it in their 1st letter

 

Not had any response to my last letter or a copy of my Original Agreement. Like most of us on here I receive 4-5 phone calls a day to my mobile and house phone which I ignore, occasionally I have spoken to them and after I tie them up in knots and refuse to be hassled and explain that I sleep well at night they hang up.

 

During the last few months I have received lots of letters explaining default sums and interest applied, and eventually received the token DN, but given 28 days from the date of issue.

 

The phone calls have now ceased and a couple of days ago I received a termination letter which according to "Cerberusalert" is what I needed.

 

My questions to you all on here are as follows......

 

Has anyone else not received their OA, even a made up one, and had a termination letter ?

 

Also is there anyone alot further down the road who can give me some advice of whats to come ?

 

I have a similar battle with our friends at MBNA but will start a different thread for that

 

My advice to anyone who reads this, is that I never let them get to me by letter or phone calls, as long as you have your health the amounts are just figures on a ststement, so keep positive as you're not alone on here :)

 

PS I owe over £10K !!!!! :D

I have received today a letter from FTC Total Credit Management saying that they have been appointed by Cap1 to secure the outstanding amount by 31st Oct or they will instruct DCA's who will use varying stetegies to recover the alleged debt !!!!!

 

I think I will send them my correspondence with Cap1 "CCA etc" and inform them that the account is in dispute and also that they have failed to respond.

 

Anyone else at this same stage ?????

Sent the "Bemused" letter to CapQuest on Friday 11th Sep which should keep them busy.

 

Spoke to Royal Mail today and they confirmed that the Postal Order I sent with my CCA request was cashed on 22nd June !!!!! :D

 

Funny that they sent me 2 letters saying that they have no record of receiving the £1.00 fee.

 

The information is now logged for future reference, all part of the game I suppose :)

Hi All

 

Just thought I would update everyone with my fight with Cap1

 

Since I sent the bemused letter to CapQuest, I spoke to someone only once who could not answer any of my questions and said that the account would be put on hold until end of Sept. Heard nothing from them since until I had a letter from Cap1 explaining that their "Specialist Team" sent their final response to my request in Sept (INCORRECT) and that they do not intend to continue with protracted correspondence of this matter. They also said that I need to pay monies to CapQuest and that they will continue their collections activity until the debt is paid etc etc.

 

I of course replied with "Account In Dispute Letter number 3" explaining that the last letter I received was in July asking me for the £1.00 fee although I had proof that they cashed it in June,:-? "So that has not gone well for them" I also explained that any protraction of this matter has been caused by Cap1's incompetence.

 

Not heard anything from either Cap1 or CapQuest for weeks now !!!!!!

Hi All

 

Finally after 3 seperate "Account in dispute" letters and nearly 5 months after my original CCA request, Cap1 have sent my alleged agreement. They said that they were sorry I didn't receive it in Sept (Funny I never received it) although they state that it is not required under Section 78 of the CCA 1974 ??????:confused:

 

They forgot to apologise for insisting they never received my payment, it was only after I told them the date they cashed the PO that they investigated it and said they received it (What Incompetence)

 

Can anyone advise on the agreement they sent me, they also attached 5 A4 pages of current T & C's (Links below) hope they work

 

Also when I applied for the card it was refused until I wrote a snotty letter and then received a phone call to say that they would issue a card.

This agreement looks a bit strange. I notice that it was taken out in 2005 yet if you look at column one under 'Other Financial Information' it refers to 2007?

Today I have received a letter from Fredricksons demanding immediate payment, I have been ignoring the phone calls as usual.

 

CapQuest seem to have given up, does that mean Fredricksons have bought the debt ??????

 

In the meantime I will send the "Bemused Letter" as this seems to a good response. :-)

Thought I would update everyone with my fight with Cap1

 

After bemused letter sent ln Nov'09 to Fredrickson's, they wrote informing me that the account has been placed on hold until further notice

 

An unbelievable 6 months passed before I received a "Letter Before Action" from Fred's in June'10 with all the usual threats about court fee's, solicitor charges and interest etc etc, of which I replied immediately informing them that the account has been on hold since Nov'09

 

As per the norm I had no reply, and yet another "Letter Before Action" was received in July'10

Still no reply and then in August'10 I received a standard request for full payment with a special barcoded payment card to enable easy payment at my local supermarket.(How Nice)

 

Still no reply to my letter sent in June, but a new company has joined the party by the name of "Bryan Carter Solicitors" who kindly sent me a letter in August'10 demanding full payment or else!!

I naturally sent them a letter expaining that I have not had a reply to my June letter sent to Fred's, but as yet not had a reply from them either

 

Today I have recieved a letter from Cap1, advising me that the account is no longer being managed by the DCA acting on their behalf, but has now been returned to them and could I kindly continue making payments to directly (The last payment they recieved was back in July'09) "left hand and right hand comes to mind here"

 

Could I kindly ask if anyone on here is 18 months or more into a dispute with our freinds at Cap1, and have had their account doing the rounds and now back with them ?

Also has anyone managed to negotiate a settlement of around 10-15% ?
