    • To add to the weight of evidence this is fraud, do you have (or can you get) proof of what the cost of the Special Delivery was?. If they paid for the weight of an envelope containing a piece of paper, they won't have paid for the cost of sending a laptop (given it is much heavier) ...... You should also contact ActionFraud.
    • @dx100uk, I'm afraid you've got this wrong. My fear of compromising my defence wasn't with regards my response to DCB Legal's initial letter per se. It was more in reference to any subsequent advice posted on this thread by other forum members and I was only being wary due to the numerous instances when some have cautioned about parking companies and their legal reps trawling these pages to stay a step ahead.   As I did also state however, I'm happy to provide full details of that initial reply to DCB Legal and have therefore reproduced it below.       Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
       
      I opted for mediation, and it played out very similarly to other people's experiences.
       
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
       
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
       
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
       
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
       
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

egg and dlc

hey everyone, i'm new to this website so please be kind.

3 weeks ago i received a phone call from dlc, saying we owed egg 15 missed payments, we told them that our debt was paid in full as we paid our last payment in nov 2008. we then phoned egg to ask for details, they told me they had deleted my account, if that is the case how can we owe then money, we have receive further phonecalls from dlc, we have explained to them that we would not pay a penny till we received proof of missed payments, we have had no respose ( just one of those postcards wanting to come and visit), can any one please help, i have asked my bank for statements dating back to 2002 so i can check for myself. but if they have no account how can we owe them, we have had no reminders or any other written response from egg saying we owed them,

can someone please advise me

Sounds like a phishing trip by dlc. Have you checked your Credit File, when did you ask for your statements.

i phoned my bank last friday but not received them yet, i'm willing to pay if i missed payments ( which i doubt) surely egg should of sent some demand( it's been 10 months since our final payment). dlc are being a pain with constant call, we have told them to write to us and not phone anymore but they have only sent a little postcard lol ) they really think i'm think and will just pay

I'd tend to ignore dlc until you get your statements, that way you'll know the score regarding the account closure.

 

I take it's for a loan, did Egg send you anything when you finished paying it ?

i think so, we moved back to uk in jan so got rid of all our paperwork (but am sure we did) do i send a letter to egg or dlc?demanding statements and other relevant paperwork,

Recorded, they then have 40 days to comply.

 

This will cost you £10, you might be wiser to give them a bit more time to send your statements as they said they would.

the statements are from my bank so i can check the payments for the loan, they were coing out by Direct debt so i can check if i missed any. egg didn't contact us to say they were getting dlc involved surely they cant do that ?

we contacted them every time we moved with our new address, and our mail was forwarded to our new address, if dlc was able to find us how come egg didnt?

we're forces so we move every 2-3 years, thy sent us mail to cyprus and germany via BFBP( british forces post office)

For £2 you can get your credit report from Experian, as Maroondevo said. If Egg genuinely got into a muddle, they will have (mis)reported to Experian who would show all the world you missed payments on 15 consecutive months. Egg would also have issue a Default Notice long ago. If none of this has happened, then it looks more like conspiracy than muddle with the DLC trying it on. The full SAR response amounts to a pile of paper one inch thick, and usually takes Egg many weeks. Just a complete reprint of your back statements will come much sooner.

 

Unless of course, your name is John Smith, with many other John Smiths on BFPO, and wires got crossed all over. The culprits who cause you undeserved distress will have to pay for it when reported to their licensor the OFT.

thanks will ask egg for subject access report and see what happens! and check all the bank statements ( will be faster than response fome egg)
