      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sorry if I appear stupid in this field, But I am, Could someone please tell me what is" unfair" charges on Bank accounts, and credit card accounts with a bank, Also is there a time limit that these charges can be clawed back from the banks.

I also noticed on an old credit card statement my wife had with Halifax from the 1990s to when it was defaulted and sold to a DCA in 2006 It was then paid off in 2007 but because they accepted 2 thirds of the money it was logged on her credit file as " partly satisfied" The old credit card statement dated 22 sept 2001 shows she was being charged for Card protection plan £8.00 per month and credit insurance of 67p per £100 as well . She had taken this card out in 1988 and had it till the default in 2002 after I had to close my small business due to Cancer a few years earlier and we got into a lot of difficulties with creditors

 

Sorry for all the questions but other may be in the same position and answers to these questions may help them aswell as myself

 

Basically to sum it up What are UNFAIR charges

that's a bit of a hard one :confused:

unfair charges are amounts charged for both bank accounts and credit cards, usually for not paying on time, going over your credit limit, returned d/ds, etc. in turn especially on credit cards, these charges then incur contractual interest.

The argument is that these charges are too high, and have no reflection on the true cost of admin to carry out, i.e, send out a letter, or return a payment.

 

PPI before 2004 (I think) was not covered by the FOS but by other set up who I can't remember!!!:lol: therefore you won't have the backing of the FOS for a complaint. (if I'm wrong here I'm sure someone will correct me).

 

If you have account numbers you can send SAR but they will only send out info for the last 6 years if accounts are no longer active. If you already have statements for credit cards showing PPI and charges you could approach the bank in question and request these back.

 

If you have active accounts that go back to the 80s/90s I think they will have the info but whether they will give it to you is another matter. :(

Hi All

 

Thanks, " Birchave0" for the very informative reply it answered every question I had, I hope it also answers some other peoples aswell.

I think I will SAR Halifax, for my wife and if I can find out who now runs the old Associates Credit card company I think I will SAR them too about an account of mine that was sold on to Cabot. I believe they are no longer, and some other bank now owns what was the Associates company, If any one has an address for them please post it on here
