On 31/01/08 I requested original CCA from Halifax, they failed to comply in the timlines, they did respond, but I am unsure if they are valid becuase there is no signature on behalf of Halifax. But at the time I was not aware o

f my next steps, so I did not know how to challenge.


It has now been passed to Moorecroft, do I need to go through the process again? Is the original contract valid.


I would be so grateful if anyone could advise, I am desperate to get this resolve.

What they've sent appears to be enforceable.


For the purposes of s.65/s.127, there is no need for a creditor's signature - that would make the agreement improperly executed, but the Court can still enforce despite this.


Under the agreement regulations, Schedule 1 contains the information needed for a properly executed agreement and Schedule 6 contains the information needed for the agreement to be enforced - creditors signature falling in to the former, but not the latter.
