Hi all, just had a call off robinscum way regarding an account i've got a ccj for (am currently working to set ccj aside).

 

I cca'd the scumbags and low and behold i got a call from them today offering me a reduced settlement figure.

 

I asked why they're offering this when the ccj is being paid.

They said that there 'system' randomly selected me for this special offer.

 

I asked them to put the offer in writing and they said ok. so at this point i huung up.

 

5 mins later the same threat monkey calls back saying they cant put it in writing as the offer needs to be accepted now.

 

I then asked him if this offer was being made because they have recieved my cca request and he said no as we havent recieved anything like that.

 

As i refused to deal with him any further on the phone, he started telling me that they WILL issue another summons.

 

i let him ramble on then said well seeing as your so adamant on sending me a mickey mouse summons i'll see you in court and hung up.

 

Since had 4 missed calls in the time its taken me to post this.

You should report them to the court that issued the CCJ as they are not allowed to try and vary the order without the court's permission. As you're paying the CCJ they have no reason to contact you, report them to TS and the OFT for harassment.

You should aslo install a recorder and record your calls as a matter of routine

They phoned me yesterday asking for a stranger. I am ex directory and at first thought they were my reply I was expecting from the job centre, the voice seemed familiar. Any how he said who are you and I accidently told them my name, shoot:(. Realised later it was a ploy and they have probably got my new number now as I put 1471 in and robbersway no. appeared.

 

Only gave it to social dwp and doctors.

 

So got to get answer machine to play dilligaf again.

(I pay the court bailiff every month and not missed a payment)

Yet robinscum way are saying that theres over £300 outstanding (true but i'm paying it) and if i do not settle immediately they will be forced to take further action.

 

They were also asking me if i had a job and a house as they 'needed to know to update my account' I asked him why he needed to update my account when it was already being dealt with by the courts and he said he needed the information so he could contact my employer to have the alleged £300 taken straight from my wages or if i had a house they would put a charge on it.

 

Why do these monkeys think they can act however they like and get away with it?

Follow my previous advice and also report them to TS and the OFT for good measure

 

Write a nice letter about them to your MP as well

Is there any law against them attempting to collect on a debt which has been ccj'd and being dealt with by county court?

the simply aren't allowed to have anything to do with it.....I can't give you chapter and verse,but they need to be very careful

Well as we all know what dca's should and shouldnt do dont seem to apply to them!!!!!

They think they are above the law.

I really would like to find out if they are breaking any laws or OFT guidlines by trying to chase me while there is a ccj which is being paid to the courts.

 

surely someone must know

Also just to let you know i've just recieved all the case details from the court.

Is it normal for the section

Date, description of case event including applications,warrant fees and costs

to have been removed (that section has been cut away)???

Even my limited knowledge from here is saying no way is that correct.

Do the so called court papers you have received have an official court stamp or case reference any where to prove that they are "legal", was the envelope they arrived franked for postage by the court (this would give you the court address) or did it just have stamps

You have the right to contact the court to confirm details but by not knowing all the relevant facts that becomes very hard

I'm sure you'll get a better informed opinion soon

yes it is a ccj.

the papers came direct from northampton bulk after i requested them.

They did come in court envelope and the piece of paper does have the case number on in too.

it looks like my 5 year old put it together on msword lol.

the reason i requested the info from northampton bulk is because i want to get this set aside as its an old next directory.

Robinscumway have bullied me for the past year (until i found this site)!!!!

they do not have a credit agreement and therefore cannot obtain judgement (legally) against me.

also never had NoA or anything else!!!!!!

My reply was based on your comment of items being removed from the paperwork but as you seem to have the relevant details, all be it on another sheet of paper I guess the fact they look like a reconstruction is another thing

if you refer to post 13 you'll see i've stated there are parts missing.

What northampton bulk sent me is an A4 peice of paper with case details at the top.

then the usual,

 

claimant = robinscum way

name and address for service and payment = horwich farrelly

Defendant = ME

 

on the right of the paper are the poc.

bottom left of the paper is missing (apart from the bit i put in bold in post 13).

date of judgement was 28th August 2008.

 

I know now that the debt was stat barred (didnt know at the time or i would've told them to shove it.

 

robinscum contacted me a couple of times earlyish last year.

then they went quiet.

Then all of a sudden i got ccj. NOT GOOD.

you should be able to get the CCJ set aside on the grounds that it was statute barred and shouldn't have gone to court in the first place

if a debt is statute barred,nothing unbars it,and the CCJ is IMHO invalid and should be set aside

Who are the bailiffs you refer to? Court appointed?
