Hi,

At the moment I am claiming high rate DLA and low rate Mobility allowance, due to me suffering with severe depression and anxiety attacks.

The question is can I claim high rate mobility allowance due to me now having a serious back complaint, which as accured due to operation to remove a cancer tumor.

The reason I am asking is I have read you have to be working to receive the high rate mobility.

I don't know where you have read that, but that's poppycock.

 

Yes, if your condition had changed/worsened, contact the DLA and follow the procedure. I'm not sure if you should re-apply altogether or whether you can simply apply for a review if is is a completely different problem, so best thing is to talk to them.

As per bookworms's advice---just phone them and ask for the appropriate forms to apply for the Higher Rate.

 

Fill them in with details as to how you are on your worst days and always keep a photocopy of your answers as it is not unknown for them to ''lose'' your forms when they are returned.

 

Always send them back by Recorded delivery.

 

Looking at the carer's allowance might also be an idea eventually.

My mistake, sorry;)

So this is not the case over here?

Also as you say I might not have to claim again, but if I do it worries me because of what we had to go through 6 years again when my wife made my initial claim.

I have now been refered to a private Physiothrapist by my GP.

I have had a couple of sessions with no improvement and he is heading towards a compressed disc, I have 4 more sessions booked to see if he can give me any pain releif+more freedom of movement.

It as been nearly 3 months since this all started and I can not see any way forward with it, so the question is do I put another claim in now or wait to see if he can make a difference with my mobility?

If no improvement then you should insist that your GP refers you to a NHS consultant specialising in problems similar to yours.

 

His advice and suggested remedy [hopefully] would then dictate how you would progress with the DLA.

 

Have you obtained and filled in the application forms for DLA?

Good question that, I think they may be worried because this all started after I woke on the recovery bed from a Cancer op:roll:

Physio as already suggested that would be my next port of call.

No not done anything about filling anymore forms in yet, because I don't know wether this is going to be a permanent issue.

The sticky issue here for me is I have been granted high rate care and low rate mobility indefinatly. I don't want to put my wife through the truma of having to fill the forms in again from scratch:evil:

With hindsight I know but always keep a copy of every form you fill in and of every letter you write.

 

I wish I had remembered to keep copies when I first filled in these many paged questionnaires/application forms as they are a nightmare.

 

You can talk to an advisor at the DLA on the phone and they will fill the form in over the phone with your answers if you really can't face filling in the forms yourself.

The forms will take many weeks to arrive on the desk of a 'decision maker' so why not make a start-you can always cancel your claim if you decide not to proceed.

As your condition has been present for 3 months and is likely to continue for the foreseeable future, you can claim NOW. Ring the DLA helpline and request a review of your case. They will ask your GP for a report and poss any specialist that you are / have seen. You may also have to go for a medical. If you really cant walk for more than twenty metres without severe pain , you should ask for a revieq. It happens quite a lot with people on the low rate motbility. They ask for a revieqw as and when their conditions worsen.

Hopefully you wont have to fill out forms. I wrote a letter to ask for a review of my Industrial Injury award and didnt have to fill in any forms. Just wrote a letter (recorded delivery) asked for the review and then got an acknowledgement. Few weeks later got an appointment for a medical. I get DLA (motability at the high rate) so havent needed to request review for that, but I would imagine its the same principle.

Hi m8, yep understand that, but in theory it will be a new claim as I get the low rate mobility for a complete seperate illness.

This started 3 months ago after a Cancer op, in which the month prior I received high rate care and low rate mobility indefinatly.
