Gents,

 

The link below shows the photos tha was sent by the council for the PCN issued. Really appreciate your advise and suggestions with regards to appealing. Thanks

Hate to say this, but it does look like you were on the bus stop.

 

IF you look at the pic i posted from google, the actual road marking for the bus stop (the red box) extends back behind the physical stop to halfway between the "humps" sign and stopping restrictions.

 

By the looks of the Council piccies (as poor as they are), you are stopped by the "humps" sign right outside the Motorcycle shop and are in the bus stop...

True, but when I take a closer look at the photo, it is slightly better. Is itn ot possible to base the appeal on the foll. points?

1. Most part of the car was outside the red area (hence not in front of the bus stop?)

2. As can be seen on the photo the car wasnt parked nad left, we could see the driver sitting which implies that.

 

Maybe the above poitns doesn't amke sense but just felt if it is worth any try..?

I can tell you now neither are valid and any appeal on those grounds will almost certainly fail. The only real hope was wrong contravention code, but the photos show it was issued correctly

PART I

 

SIGNIFICANCE OF BUS STOP AND BUS STAND CLEARWAY MARKINGS

Interpretation of Part I of Schedule

1. For the purposes of this Part of this Schedule -

 

 

    (a) "clearway" means an area of carriageway bounded by the continuous and broken straight yellow lines comprised in the road marking in diagram 1025.1, 1025.3 or 1025.4 and "bus stop clearway" means a clearway on which the words "BUS STOP" are marked; and
     
    (b) a vehicle shall be taken to have stopped within a clearway if -
     
      (i) any point in the clearway is below the vehicle or its load (if any); and
       
      (ii) the vehicle is stationary.
