:pHi I am new to this site and I have tried to follow some of the threads on this subject = however getting a bit lost. can anyone help please? I have had a response from moorcroft as follows:"in the meantime we believe that it may be of assistance to all if we ensure any areas of potential dispute are addressed prior to any court action. to this end can you provide an indication of the information you will be relying upon, when giving evidence to the court or information to the relevant statutory authorities in relation to the alleged subject matter of this account. please could you provide this information by return to minimise potential costs and delays" (They also state that they have requested the CCA from their client.)

Can i just ignore this or should I reply? many thanks x

Put your feet up and relax, see what they do next. Don't worry about it.

If they don't provide the evidence requested from your CCA request then the debt is not enforceable and won't be unless they provide the evidence.

:!: Activ Kapital 2009 - £316 debt cancelled due to no credit agreement

:!: TNC Legal Collections (Swinton) - £61 written off due to complaint being upheld with the FOS

If you are making any payments now send this http://www.consumerforums.com/resources/templates-library/86-debt-collectors/571-failiure-to-provide-a-copy-of-the-agreement-within-the-prescribed-timescale when their time expires & stop payment.

If you are not paying anything now, carry on not paying. :D
