Hi I have a problem


An old landlord of mine has passed a council tax bill (over 1 year old) onto my ex flatmate at her parents address. When we rented the property from him (AST 12 month with a 6 month break clause) it included all bills including council tax.


There was an error on the contract and there was a section where it said the tenants have to pay the bills however he scrubbed this out and signed it.


We took him to court last year over non return of our deposit and won.


The Council tax people say we have to pay it and reclaim it from him. Is this true?

Hi, no we wasn't on the electoral role or anything like that, no bills, only the TV licence.

I have decided to take my ex-LL to court again as he is not going to pay the Council Tax despite what it asts in out AST


Here is my POC, do they sound ok?


Brief Details of Claim

A monetary claim to reclaim money for Council Tax that the defendant refused to pay


Particulars of Claim

1. The Claimants rented a property xxxxxxxxxxxxxxxxxxxxx from the Defendant between xxxxxxxxx - xxxxxxx


2. The Defendant included all utility bills and Council Tax with the rent of £xxx per month. This was stated on our Assured Tenancy agreement for 12 months.


3. It was at this time at the start of the tenancy that the Defendant named us the tenants liable for the Council Tax which is a breach of what was stated in the contract.


4. Since our departure we have had to issue a court claim against the defendant for the non return of our security deposit of £xxxx which was awarded in our favour and has now been paid by the Defendant.


5. The Defendant has declined to pay the council tax for the 12 months we rented the property from him and has used that part of the rent elsewhere.


6. We claim the sum of

a) £xx and £xx total £xxxx

b) £xx in 8% interest at a daily rate of £0.19p up until a settlement or judgement

c) Court fees (if any)


We believe that the contents of these particulars of claim are true.
