      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am fuming , I now understand why some people do not want a job! As most of you know I started work after 2 years of being unemployed in August this year, well I did all the right things, IE informed Job Centre and of course as I was getting some housing benefit and help with Council tax they had to be told as well, now I explained all this to the job centre and was told not to worry as you get 4 weeks grace? I also understood they helped you get back to work as am sure they used to give you £100? Well lo and behold the benefit has been suspended! I have to take wage slips in but they only give you so long to do this otherwise it is stopped altogether.Yesterday my HA officer asked me for over £400 rent arrears which I was not told about, we have been paying bedroom tax as nobody told us otherwise, I do not have this sort of money, I am only getting £200 a week at the moment as am on a probation period and my tax is sky high as only just got my P45 from job centre. I somehow wish I had stayed on the dole!

So much fluff and fuss about Syria, not that it's not worthy, but what about the chemical warfare that's dished out daily by the denial of drugs and treatment to patients in the Western World to save lives or any part of the world? I don't see summits about what's inhumane in that and why Governments can pick and choose who lives and who dies according to wealth and status. The lucky ones die quickly without being a burden. Just saying...Rant over..

Local councils seem to be run on 'template' systems at the moment (I suspect they have a large influx of 'apprentices' on board to train) and anything which needs a proper reply can't be immediately dealt with.

 

They are also suffering from the 'left hand not knowing what the right hand is doing' and 'joined up writing' seems to be a talent they do not possess!

 

As for the troll problem on here - it is now half-term and a lot of bored people around. Maybe they are suffering from boredom. I still love the immortal line in the 'Elf' film 'trolls were not house-trained!'

One of mine is dry mouth.

 

I've been on it for a week and have to take it in the evening. Took it at 6 last week and was falling asleep by 9.30.

 

The side effects are so much better than having too much pressure in my head, though. (which is why I'm on it)

I noticed that too Bobcat2, if you open it and then leave it open and just close the individual tabs it works a bit better. There was an upgrade the other day which seems to have screwed it up.

 

Going to see the council this morning and find out exactly why they think I had a housing benefit overpayment when they now have identified an underpayment for the same week.... they cannot do their sums nor link dates properly.

 

Noddle also seemed unable to properly identify me so I've asked them for the problem and pointed out that I can verify my address via council tax records (it may be that I have opted out of the edited council tax register and this is the one they use).
