    • Thanks for opening, it's been another rough year for my family and I've procastinated a little.. Due to the age of my defaults on this and other accounts (circa 2021), I really need to avoid a CCJ as that will be another 6 years of credit issues. Mediation failed as I played the 'not enough info to make a decision' however during the call for some reason they did offer settlement at 80%, I refused. this has been allocated to small claims track, court date is June 3 and I've received their WS. I'm starting on my WS and wonder what your advice would be given the documents they have provided?. They do appear to have provided everything required of them (even if docs could be reconstructions). Not really sure what my argument is anymore but I do want to attend court and see this through. Should a judgement be made against me then I will clear the balance within 30 days and have the CCJ removed - this is still possible isn't it? I'm going to be reading up today and tomorrow and hope you can provide me some guidance in the meantime. Thanks as always in advance
    • I have now received my SAR. It includes a great deal of information! Is there a time limit on how long account information is kept and/or can be provided to debtors? I have received many account statements which were not previously sent to me. I remember that the creditor should provide explanations of any acronyms and abbreviations that maybe used in the documents. Is this still the case? Also what, if any, are the regulations in regard to adding fees to a debt? Can fees be added to a debt after the court has approved a charge on a property. Perhaps due to the numerous owners of the debt, many payments I made were not properly recorded on the account, some were entered over a year after the payment was made! Following the Legal Charge, I paid every month until my payments were refused. I am trying to compute the over payments, but the addition of fees etc. is confusing me. Any comments and/or help would be appreciated.

    • They have defended the claim by saying that the job was of unsatisfactory standard and they had to call another carpenter to remedy. My husband has text messages about them losing the keys a second time and also an email. What do they hope to achieve??? Most importantly,  as far as I have seen online, now I need to wait for paperwork from the court, correct?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

know it all's who frequent these boards who know more than I do about my illness's and how my life runs.....seeing that theirs probably runs smooth and anyone who has a fight on their hands for their health seems to upset that person when stating MY facts about MY plight with MY gp's and the shyte way my hospital FAILS to help if you rub the wrong way

Bear in mind Lloyds and Co-op are getting into bed together, although it is Co-op taking over. There was a time I'd have agreed with Burly on this, but I'm looking to change to a Building Society. Toying with Nationwide or Coventry (as it's local and say they won't demutualise).

Not at all burly. We all share what we know and I only know about co-op and Lloyds as I bank with smile so been notified about it, and I know NO has had problems with Lloyds.

I only thought of Britannia due to I had some accounts in there for small savings and the boys when Sue and i used to save little amounts for them ....when they came of age ....they blew it all without my knowledge grrrrrrr

There was someone like that on a forum I moderate. He claimed to have provided proof that everyone who has a problem with their heart, it's self inflicted. He hasn't provided the proof and there's stuff (such as various sources saying that many children born with conditions like Downs Syndrome) are born with their heart condition and it's something out of the control of the mother and baby.

My heart was destroyed almost 14 years ago Nyst when my wife passed away and then 7 years later it was destroyed again due to stress smoking and overwork so I stopped smoking that very moment and hate the stench of them now....the stress is still with me and as for work ...well thats part of the reason I am on here a lot sometimes during the day....my arms neck,shoulders and now my spine is now affected by the numerous lumps that have migrated all over my back and under the muscle mass and then this person seems to think that due to I missed an appointment I should not be perhaps allowed more appointments ...I am considering reporting the persons attack on me due to thats how I read it

getting a letter from my HA re the bedroom tax, grr, do you still have to pay this is you are working or have your own house? Myself and o/h for various reason have not shared a bed or bedroom for years but seems we still have to pay this stupid tax, we have a 2 bed semi

I want to find out more about this shyte and nasty tax due to a friend of mine told me it affects everyone ....home owners aswell as rented etc but can you see their mates in mansions paying up or will there be a old mates dispensation......this govenrment are the worse bunch of mankie bastiods that ever took the pyss out of joe public and without a doubt all for their mates ....the wealthy w-kers and bankers.....oops silly me they are one of the same

Finding out today that dwp have suspended my esa without informing me because they only take into account the first 3 months of my 6 month fit note because it was an initial one; grrrrrrrrrrrr Only found out when my debit card was declined and now after rushing to my gp asking for another fit note finding out that I can't pick it up until tomorrow and then having to rush it to jcp if I can get an emergency appt.

I have no money for the bus fare so will have to walk to the jcp which is a good 30 mins walk from my home and I suffer from bad feet!!!!!

 

As the jcp are not open xmas eve I'm hoping to get things sorted out tomorrow and if not I will have no money over xmas

force your point across at the job centre they can fax it over it's not a big issue for them unless they make it so.....our job centre is a joke....theres three doormen in there and a midget to escort you to someone.......too many suits again but seeing that most of the manufacturing jobs are gone now I supose the apes have to do something when not working the clubs......it's true .....you could NOT make this up

 

ps not taking the pyss out of small people BUT out of the three doormen and the midget a few months ago when I had to drop in to get my initial sick note sorted the midget got the short straw 'no punn intended' of directing me to my quizzer who was sat at her desk about 4 feet away from where I was standing with the midget....yep i kid you NOT

Why O why do they not inform you in advance of suspending your allowance? If I owed the dwp money they would soon let me know

 

Xmas on my own is bad enough but without any money to boot!!!!! I have been swearing all day.

 

I have worked all my life until losing my job at the age of 59 and after 8 months on jsa found a job in a hotel which lasted for 18 months until I became ill;

NOT MY FAULT !!!!!

Anyway; I have the tele and some pasta in the cupboard

my god frau what the hell is happening .....I had dwp write to me to tell me that my sick note would revoke me of any money and would cause me problems if I didnt get it to them by 21st dec so I got it re-done and sent off on 13th due to I explained to the doc that due to the xmas rush I could be in trouble....'this new doc I'm seeing is the only one out of 7 i'd seen before who recognises I have problems due to lumps in my shoulder and back....not our fault we're ill Ian Dontcare Smiff or that HE is a total pr-ck
