    • Thank-you dx for your feedback. That is the reason I posted my opinion, because I am trying to learn more and this is one of the ways to learn, by posting my opinions and if I am incorrect then being advised of the reasons I am incorrect. I am not sure if you have educated me on the points in my post that would be incorrect. However, you are correct on one point, I shall refrain from posting on any other thread other than my own going forward and if you think my post here is unhelpful, misleading or in any other way inappropriate, then please do feel obliged to delete it but educate me on the reason why. To help my learning process, it would be helpful to know what I got wrong other than it goes against established advice considering the outcome of a recent court case on this topic that seemed to suggest it was dismissed due to an appeal not being made at the first stage. Thank-you.   EDIT:  Just to be clear, I am not intending to go against established advice by suggesting that appeals should ALWAYS be made, just my thoughts on the particular case of paying for parking and entering an incorrect VRN. Also, I continue to be grateful for any advice you give on my own particular case.

    • Yeah, sorry, that's what I meant .... I said DCBL because I was reading a few threads about them discontinuing claims and getting spanked in court! Meant  YOU  Highview !!!  🖕 The more I read this forum and the more I engage with it's incredible users, the more I learn and the more my knowledge expands. If my case gets to court, the Judge will dismiss it after I utter my first sentence, and you DCBL and Highview don't even know why .... OMG! .... So excited to get to court!
    • Yep, I read that and thought about trying to find out what the consideration and grace period is at Riverside but not sure I can. I know they say "You must tell us the specific consideration/grace period at a site if our compliance team or our agents ask what it is"  but I doubt they would disclose it to the public, maybe I should have asked in my CPR 31.14 letter? Yes, I think I can get rid of 5 minutes. I am also going to include a point about BPA CoP: 13.2 The reference to a consideration period in 13.1 shall not apply where a parking event takes place. I think that is Deception .... They giveth with one hand and taketh away with the other! One other point to note, the more I read, the more I study, the more proficient I feel I am becoming in this area. Make no mistake DBCL if you are reading this, when I win in court, if I have the grounds to make any claims against you, such as breach of GDPR, I shall be doing so.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

due to I made a real complaint about the surgery to the GMC and the GMC obviously got back to the surgery and it's my line of thought that certain gp's thought that if it goes to court and they have notes of me seeing a shrink then any case would perhaps go against me........I dont need any ologist looking into my head or anywhere else .....I need a biopsy and i need it done privately now due to I have NO trust left in my GP's or local NHS.....too much to think about D/T I know what my thoughts and or suspicions are but will not be putting all of them up on here just in case

How insensitive some people are:

 

A friend of a friends' husband got stabbed at a Jessie J gig. He later died in hospital. The Bottle Stop campaign has been set up. The man was sentenced to a minimum of 14 years. A mutual friend said "he didn't mean to kill him". How would he know? He wasn't there. Only one person knows what his intentions were.

Hit someone with a weapon and the person dies, it's murder, simple decision for the judge.

 

Dealing with someone being taken from you, it matters little of the persons intention, only the result :(

 

Channeling energy into "the bottle stop campaign" is probably the way to go.

 

According to a landlord friend of mine, Violence was the reason that they stopped using the traditional pint glasses.

anyone who goes out and uses whatever as a weapon and then uses it and does the ultimate deadly deed of killing someone should be locked up without and thought of parole.....I knew someone years ago"not a friend" who always went out and was well known to always carry a knife....he killed someone at a dance over a lost 10p coin in a fruit machine "yes 10 p"............I look at what the dead persons family has left............nothing so therefore the killer should have nothing likewise I also feel that Brady should be given a truth drug and likewise the bastard in Wales to tell where poor little April is so her mum and dad can bury her in a proper consecrated grave and likewise Jimmy So-Vile should be exhumed and cremated and then seal the ashes in a pure glass block and drop it into the deepest part of the ocean so it stays for ever in blackness

 

So-vile's family should pay for it and then take his wealth and give it to Bernado's likewise Gadd and the rest of the **** should forefeit their money too

whats made me swear is the fact that George Entwistle is to be paid £450 k severence pay for his 54 days......er erm work and the trustees of the BBC have defended the payout due to Enwistle will be helping out with the So-vile enquiery.....there will be a host of others now that will want paying for their time on giving evidence now due to this .........no you couldnt make this up and it can only happen in bent england

There is a lot of talk on the news about that payment, and the fact that it is coming from OUR money which pays the licence fee.

 

If the BBC wanted to do the 'honourable thing' they should scrap this payment - the bloke was a bit part player in the Jimmy Saville scandal so why he should get a full years salary I don't know.

 

On that basis I should have had a whole years salary from LU when I got made redundant, it was nothing to do with me that my boss's job was cut from the company structure so I should have had that 'benefit'.... this double standards at the top HAS to be stopped.

reading that SIAC=SICK has allowed Qatada his freedom and he'll be let loose this week..............why is it there's never a sniper around when you need one.

Also how dare Chris Patten say that Entiwstle's 450 k is ok......lets see if he himself is on a list that the ........perv police will be investgating....it all stinks to high heaven ....I'll let you know in due course what else pysses me off today....maybe a doctor due to I am going to thump his desk at about 11 am "my appointment is at 10:10 but you all know the sketch at surgeries....11 am maybe a bit previous a guess for me but I will be demanding the biopsy today and will not take diversions as an answer...i've had a gutfull of their hollow words

Last time I went to the GP (last week) they had a sign up saying how many people had 'missed' appointments - I did point out that their stats did not include

 

People who died

People who were in hospital at the time of their appointment

People unable to get to the appointment due to illness - either theirs or a carers

 

Once they took those lots of figures out then the sum would be completely different.

 

My appointment was meant to be 1.40, got to 2.10 and me and another lady went to the old dragons on reception, who then found out that the GP we were booked with was on holiday and they had to chase round for a locum.... I quietly pointed out that that is another lot of people they need to exclude from their stats.

 

Locum wasn't available for 2 hours but they did get me my flu jab in between - and I had another appointment in town in between too... luckily it is in walking distance otherwise I would have been very very very miffed instead of very very miffed.

 

They also now need to exclude Patients messed around with by the surgery - there were 9 people on the list for the non-existent GP, and one of the two dragons was busy phoning rearranging appointments.

I'm always waving away their comments at my GP's reception and especially when a top receptionist called a black doctor "coloured" and I pulled her up on it and told her thats about the wrongest word she could use when talking about him.

I actually got in there at 10:09 and clicked myself in via their screen and sat my bum down only to have to stand up and go see him about 20 seconds later.....my biopsies will be done asap due to he has seen marked developments and spread of the hard jelly like lumps right down the centre of my back and now I cant keep my head up looking strait for too long.........just under FOUR f-- years ago this started FOUR ...

Why weren't you told this? A few years ago, we had snow. My parents took a phone call informing them (I wasn't there at the time) that the appointment I had booked has to be cancelled due to him not being about to the snow. I called them and asked for the GP to call me tomorrow, if he's in.

 

What made swear today - asked if I could have my CDs back at volunteering. (I'd left them behind and they were put in a plastic bag with my name on) I asked if anyone had seen a black CD wallet of mine and got told no. One of the volunteers said that someone has also taken a CD of hers. Not pleased at all - the CDs in that wallet are ones I made myself.

I wasn't informed as I was already AT the surgery, and the surgery had no idea until they checked that the doctor was not in..... no wonder their Head Receptionist is on extended sick leave! The administration of the place is dreadful, unless you insist on seeing the same doctor twice in a row you get any one.

 

Another example is that I was told by the doctor to make an appointment for two weeks time, I asked them to put it on my record, so they did. I went to reception on the way out and asked to make an appointment for that GP for two weeks time, only to be told 'You can't pre-book that far ahead'. I asked them to look at what the GP has written on my notes, they did and I ended up with an appointment with the same GP for the two weeks later!

This is terrible reading how surgeries differ in their attitude to patients and the quality of care. A lady at work was telling me tday she asked the surgery if the results had arrived for a CT scan for her husband he had nearly a month ago,to be told they couldn't find anything. She said they must have arrived by now and she was told if she wasn't happy at the surgery she could transfer to another one! I told her that is unacceptable. My surgery received CT scan results for a member of my family within ten days. I suggested she ring the CT dept and ask when the results were sent as Surgery say they don't have. If they've been sent make an appointment with GP so it can be sorted there and then.

Being to register elsewhere is a bit of an OTT reaction!

 

I did receive a letter about MRI results. Made appointment and was told "they found something and are unsure what. The good news is, your brain is still there". :lol: Took about 14 months and another MRI to find out what's wrong. No-one can tell me the prognosis.

can you imagine how it feels to have to call PALS three times and on the third attempt............find out that the first two calls were not even acted on and now it looks like the thrid one wasnt either.....my solicitor didnt even know what Pals were but i suppose if you're in Bupa ...you wouldnt know

my prognosis is fatty tissure from my MRI's ....fatty tissue covers a mulitude of white coat bullcrap but only I have the stabbing horrible pains that the fatty tissue is now fanning out....just stepped downstairs and it feels like someone is standing on my spine :-x

I didn't. :( He wrote to my GP and said "we have no idea what the prognosis is".

 

What made wear today - I spell my name differently to how it's normally spelt. I sent an email to someone saying "when you next write to me, please write "Miss ***** *******" on the envelope".". They replied and said "yes, I will write Miss ****** ******" on the envelope". I am getting so fed up of this now. My social worker doesn't spell my name properly either.

Male arrogance!!

 

Parked my car outside the chippy tonight parallel to the curb, hubby went in to get food!

 

Car in front moved only to be replaced by some delinquent male driver who thought it would be hillarious to park 2 millimeters from my front bumper!

Car behind me moved out and was replaced by some large heffer of a car, driven by a male, that actually couldn't get close enough to the curb so stuck out in the road and again parked 2 millimeters from the rear of my car.

 

I jumped out of my car and politly said to the driver that I couldn't get my car out because he had parked so close to the rear of my car.

I showed him the front of my car where the other driver had also parked too close to my car.

 

His comment was, " you can reverse out of there! I could get out of there! I am always getting out of spaces like that!"

My comment was, " excuse me? I cannot get my car out."

He repeated his comment just before my husband came along and then he got in his car and moved it!

 

He not only used his large car but also his extreme height to tower above me and intimidate me!

 

What a PRAT!
